No person shall carry on the business of any auctioneer or sell
or attempt to sell or offer for sale goods, wares, merchandise or
property at auction or public outcry without having first obtained
a license therefor; provided, however, that this chapter shall not
apply to sales made pursuant to some order of court or public law.
Fees as set from time to time by the Village Council shall be charged
and collected for the use of said Village.
No person shall follow or carry on the business of hawker or
peddler or sell or offer to sell or display for sale or barter or
exchange any goods, wares or merchandise upon or along the streets
or public places of said Village without first obtaining a license
therefor, nor shall any transient trader or dealer engage in or attempt
to engage in business or sell or offer for sale or barter or exchange
goods, wares or merchandise within the limits of said Village without
obtaining a license therefor.
No person shall follow or carry on the business of transient
dentist, doctor or vendor of patent or proprietary medicines or attempt
or offer to carry on such business or shall display, sell or offer
or attempt to sell such medicines within the limits of said Village.
In all cases where a license is required as heretofore specified,
such license shall be issued by and the fee therefor paid to the Clerk
of the Village, and in his/her absence such duties shall be performed
by the President of the Village. No license shall be issued until
the terms and conditions of this chapter shall have been fully complied
with in accordance with the schedule of permits as adopted by the
Village Council.
Every license issued under this chapter may be revoked by the
Village Council at its pleasure, and no person holding any license
under this chapter shall neglect or refuse to produce and show same
to the police agency of the Village of Michiana.
Any person or firm convicted of violating any of the provisions
of this chapter shall be punished by a fine of not more than $100
or imprisonment in the County Jail of Berrien County for a period
of not more than 90 days, or both such fine and imprisonment, in the
discretion of the Court.
