As used in this Part, the following terms shall have the meanings indicated:
CONSTRUCTION DUMPSTER
A roll-off waste container transported to and from the place of use by trucks or trailers and positioned at a construction site for the collection and eventual disposal of construction waste.
A. 
Single-family residential zones. No construction dumpster shall be located within 10 feet of an abutting structure, unless the owner of the abutting structure has agreed to such and has signed the authorization form which shall be submitted with the permit application for the dumpster. No dumpster shall be placed so that it blocks any public sidewalk or street. The authorization form shall be made available upon request by the Construction Code Official.
B. 
Multifamily, commercial and industrial zones. No construction dumpster shall be located within 10 feet of an abutting residential property unless the occupant of the abutting dwelling agreed to such and signs the authorization form which shall be submitted with the permit application for the dumpster. The authorization form shall be made available upon request by the Construction Code Official.
C. 
Dumpsters shall not be placed on any public street, public easements or rights-of-way or obstruct public sidewalks.
D. 
Time limitations.
(1) 
Single-family residential zones. A construction dumpster and any replacement dumpster placed under this Part may be placed for not more than a total of 30 days in any six-month period.
(2) 
Multifamily and commercial. A construction dumpster and any replacement dumpster placed under this Part may remain in the site as long as required, but not to exceed a total of six months.
(3) 
Industrial. A dumpster or any replacement dumpster placed under this Part may remain on the site as long as needed, but not to exceed a total of 18 months.
(4) 
Provided that there is an open construction permit for work on the property in question, the time limitations set forth in this section may be liberally extended at the discretion of the Construction Code Official.
E. 
Sanitation. The following requirements shall be maintained while the construction dumpster is on or at the site:
(1) 
The area around the dumpster shall be kept free of debris and litter;
(2) 
Any dumpster into which animal or vegetable waste or material has been dumped or deposited shall be removed or emptied within 24 hours;
(3) 
Any dumpster producing or causing noxious, foul or offensive odors shall be immediately removed or cleaned to eliminate the odor; and
(4) 
A full dumpster shall be removed from the site and emptied within two days.
F. 
Usage. A dumpster shall only be used to contain and remove debris and material generated at the location where the dumpster is placed.
G. 
Identification. The name and telephone number of the owner of the dumpster and/or the company that is responsible for the dumpster shall be displayed in a weatherproof manner on the dumpster.
H. 
Permit required. A permit shall be required for a dumpster. The permit shall be obtained from the Construction Code Official after paying the required fee of $25. The permit shall be displayed in a weatherproof manner on the dumpster.
I. 
Abatement. Any dumpster not in compliance with this Part is hereby declared to be a public nuisance and may be abated by the Township at the owner's or responsible person's expense. Abatement shall, at the Township's option, include the removal and/or the emptying of the dumpster.
Nothing in this Part shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed pursuant to this Part, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Part.
A. 
Any person who allows, keeps, places and/or maintains a dumpster on a site within the Township of River Vale without obtaining a dumpster permit shall be in violation this Part.
B. 
A violation of any provision of this Part is punishable by a fine of not less than $500 per day for the first such violation, and up to $1,000 per day for the second or subsequent violation. Upon and after a third violation, the penalty that may be imposed, in addition to the fine set forth above, may be imprisonment for a period not exceeding 90 days, or both.
C. 
Any violation issued and fine imposed as a result of a violation of this Part shall be imposed against the property owner even if a tenant of the property owner obtained the storage container which resulted in the issuance of a violation or imposition of a fine.
