[Derived from Ch. 5A of the 1971 Code]
There is hereby established in the Township a State Uniform Construction Code enforcing agency to be known as Division of Licensing and Inspection, Department of Community Development, consisting of a Construction Official, Building Subcode Official, Plumbing Subcode Official, Electrical Subcode Official, Fire Protection Subcode Official and such other subcode officials for such additional subcodes as the Commissioner of the Department of Community Affairs of the State shall hereafter adopt as part of the State Uniform Construction Code. The Construction Official shall be the chief administrator of the enforcing agency.
Each official position created in § 130-1 above shall be filled by a person qualified for such position pursuant to N.J.S.A. 52:27D-126 et seq. provided, that in lieu of any particular Subcode Official, an on-site inspection agency may be retained by contract, pursuant to N.J.A.C. 5:23-1.1 et seq. More than one such official position may be held by the same person; provided, that such person is qualified pursuant to N.J.S.A. 52:27D-126 et seq. and N.J.A.C. 5:23-1.1 et seq. to hold each such position.
The public shall have the right to do business with the enforcing agency at one office location except for emergencies and unforeseen or unavoidable circumstances; and for the purposes of this article, such office shall be that of the designated Township Construction Official.

A. 
Pursuant to N.J.S.A. 52:27D-127, there is hereby established a Construction Board of Appeals to hear appeals from decisions by the enforcing agency. Such Board shall consist of five regular members. The membership as a whole shall include individuals qualified in the disciplines of electrical, plumbing, building and fire subcode and a certified fire official. A member may qualify in more than one discipline. Any regular member not fulfilling the qualifications required of the Board as a whole must have at least five years of experience in the construction industry.
B. 
In addition to the five regular members, the Board shall include two special members, one of whom shall be a licensed professional engineer with municipal construction experience, and one of whom shall be a builder.
C. 
The Board shall include three alternate members with one of the qualifications required of either a regular or special member.

A. 
The Township Council shall appoint the Board members and any alternate members. Members shall be appointed for a term of four years. Vacancies shall be filled for the unexpired term.
B. 
The Township Council shall appoint such number of alternates, as may be appropriate, for terms not to exceed four years, or may, in the alternative, appoint alternates on a case by case basis.
C. 
No regular or alternate Board member may be a member of the enforcing agency, the decisions of which are subject to the review of the Board.
D. 
Pursuant to N.J.A.C. 5:23A-1.2, the Township Council, as the appointing authority, shall annually designate from the regular membership of the Board a person to serve as Chair and as Vice Chair or it may delegate responsibility to the membership to select its officers at its annual reorganization meeting which shall be called within the first 60 days of each calendar year.
No regular or alternative members of such Board shall receive any compensation; except, that they shall be compensated for any expenses incurred in the course of such duties.

A. 
All appeal applications shall be accompanied by a fee as established in Chapter 156, Fees, made payable to the Township of Lawrence. An application shall be considered incomplete unless accompanied by said appeal application fee.
B. 
In the case of an appeal based on the failure of the enforcing agency to act within any time frame specified, the fee shall be waived. Furthermore, the Construction Board of Appeals shall have the authority to order the reimbursement of an appeal application fee upon a showing of good cause or if the Board deems reimbursement appropriate. The Township shall reimburse an appeal application fee to the appellant if so ordered by the Construction Board of Appeals.
