No person shall locate and construct, alter or operate a swimming
pool until licenses therefor shall have been issued by the Division
of Health.
The fees for a license to locate and construct, or to alter a swimming pool are located in Chapter
156.
Licenses issued for the operation of a swimming pool shall expire
annually on April 1 and application for renewal thereof shall be submitted
together with the required fee prior to March 31 of each year.

When, in the opinion of the Construction Official, a swimming
pool or other artificial body of water, temporary or permanent, by
virtue of size, depth, accessibility, location or proximity of children,
is determined by the Construction Official to be a hazard, the owner
shall be required to surround it with a fence, wall or other enclosure.
The enclosure required for permanent installations shall be a minimum
of four feet in height, but those for temporary installations may
be of less height or omitted entirely when, because of shallow depth,
small size and similar factors, the Construction Official determines
that none of the safety purposes intended by this section would be
served by its application to such temporary swimming pool.
