Employees of Albany County are entitled to user name and password privacy on their own electronic communication devices, including, but not limited to, computers, telephones, personal digital assistants and other similar devices that use electronic signals to create, transmit and/or receive information. Employees of Albany County are also entitled to user name and password privacy for personal accounts accessed through their own electronic communications devices.
No department head or other person acting in a supervisory capacity or any agent of a department head or other person acting in a supervisory capacity, or any other person in a position of authority within Albany County government may request that an employee or applicant for employment with Albany County disclose any user name, password or other means for accessing a personal electronic communications device or a personal account accessed through such electronic communications device.
No Albany County employee shall be discharged, disciplined or otherwise penalized and no applicant for employment with Albany County shall be refused employment as a result of their refusal to disclose their user name and/or password for their own electronic communications devices or personal accounts accessed through such electronic communications devices.
Unless otherwise prohibited by statute, regulation or other law, this prohibition shall not prohibit any department head or other person acting in a supervisory capacity, or any agent of a department head or other person acting in a supervisory capacity, or any other person in a position of authority within Albany County government from requiring any employee to disclose any user name, password or other means for accessing accounts or services that provide access to Albany County's internal computer and information systems.
