It shall be unlawful for any person, firm, partnership, corporation or unincorporated association to burn any leaves, refuse, garbage, waste material, cars, vehicles or parts thereof, or other debris outside of any building at any time within the Borough of Morrisville, Bucks County, Pennsylvania.
Notwithstanding the foregoing provisions, if the Borough Manager finds that:
A. 
Conditions exist in any area of the Borough whereby, for a limited time, all waste and refuse therein cannot be disposed of in existing incinerators or by other authorized methods;
B. 
The accumulation of such waste and refuse constitutes a menace to the public health;
C. 
Such waste and refuse must be disposed of daily in order to protect the public health;
D. 
Such waste and refuse cannot be adequately and safely disposed of in any manner other than by burning in open fires; he may make an order authorizing the open burning of waste and refuse accumulated in any area of the Borough, or specified types thereof, on Borough-owned or privately-owned property located within such area. All such orders are to be in writing, shall be filed with the Borough Manager, shall specify the particular area upon which such burning shall be permitted, shall state the nature of the item to be burned, and shall in no event be effective for a period of more than 30 days.
It shall be lawful to burn wood, charcoal, and/or other materials for the purpose of cooking food out of doors when burned in a barbecue, barbecue pit, stove, fireplace, or other container sufficient to prevent the escape of ignited particles.

Any person, firm or corporation who shall violate any provision of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not more than $300, together with costs of prosecution, or to imprisonment for a term not to exceed 30 days. Every day that a violation of this chapter continues shall constitute a separate offense.
The Borough Council, Borough Manager, Borough police, or any officer or employee of the Borough, is hereby authorized to give notice to the owner or occupant, as the case may be, of any violation of this chapter, and may file a complaint before the Mayor or any Justice of the Peace against the owner or occupant, of such offense.
