Any pool, portable or permanent, which is used or intended to be used
for swimming, bathing or wading, over 24 inches in depth or with a surface
area of 150 square feet or more, shall, for the purposes of this chapter,
be a swimming pool.
All swimming pools in the Borough of Morrisville shall be constructed so as to comply with the minimum setback and sidewalk requirements of the structures in the pertinent zone, as set forth in Ch.
465, Zoning, of the Code of the Borough of Morrisville, as amended.
All swimming pools shall be completely enclosed by a five foot chain
link, welded mesh, solid masonry, solid wooden or picket fence with spacing
no greater than two inches and the gate must be kept locked when the pool
is not in use, and all fences shall be not less than six feet from the water's
edge. All excavation for pools or other water areas shall be completely surrounded
from the time construction begins by suitable temporary fencing.
No swimming pool shall be closer than six feet to existing property
lines.
It shall be unlawful to empty or drain swimming pools into the storm
sewer system or into or upon the streets of the Borough.
Water emptied or drained from swimming pools must be emptied into the
sanitary sewer system.
All swimming pools in the Borough of Morrisville must be equipped with
a filtrating system sufficient to maintain the filtration of the water in
said swimming pool in accordance with specifications to be obtained from the
Building Inspector.
Anyone desiring to construct or erect a swimming pool in the Borough
of Morrisville shall make application for same on forms supplied by the Borough
and shall accompany such application with a copy of the plans and specifications.
The permit fee for swimming pools shall be the same as the permit fee
as set down by the Building Code of the Borough of Morrisville.

Any person, firm or corporation who shall violate any provision of this
chapter shall, upon conviction thereof, be sentenced to pay a fine of not
more than $300, together with costs of prosecution, or to imprisonment for
a term not to exceed 30 days.
All swimming pools constructed or erected prior to the enactment of
this chapter shall not be considered to be in violation of the provisions
of this chapter pertaining to height of fence, distance of fence from water's
edge, and distance of pool from existing property lines, provided such pools
are completely surrounded by at least a four foot fence with openings no greater
than four inches.
