It shall be unlawful for any person to canvass or to solicit contributions
or funds from the general public with the Borough for any religious, charitable,
patriotic, political, philanthropic, public interest or community service
purpose without first applying for and obtaining a solicitation permit.
At least 30 days before the date canvassing or soliciting is to begin,
applicants for a soliciting permit under this chapter must file with the Police
Department an application in writing on a form or forms to be furnished by
the Police Department which shall provide the following information:
A. The name of the person, organization or institution,
its aim and purpose.
B. Local and national address and phone numbers.
C. Names and home addresses of each corporate officer (if
applicable), together with a complete list of names and home addresses of
any board of directors.
D. Dates of intended solicitation.
E. Names of person authorized to solicit, their home addresses,
phone numbers, social security numbers, driver's license number and state
automobile registration information and a photograph.
A soliciting permit issued by the Police Department shall be valid for
the period of intended solicitation as specified in the applicant's application
but in no event for more than one year.
Every applicant for a permit under §
151-2 of this chapter shall pay a processing fee of $10 plus $10 for each person desiring to solicit as provided herein.
Hours of soliciting shall be limited to 9:00 a.m. to 9:00 p.m., Monday
through Saturday.
Solicitors are required to exhibit their permit at the request of any
citizen or police officer.
It shall be the duty of any police officer of the Borough to require
any person seen soliciting and who is not known by such officer to be duly
licensed to produce his solicitor's permit and to enforce the provisions
of this chapter against any person found to be violating the same.
All annual permits issued under the provisions of this chapter shall
expire on the 31st day of December in the year when issued. Other than annual
permits shall expire on the date specified in the permit.
Any person violating any of the provisions of this chapter shall, upon
conviction thereof, be punished by a fine not to exceed $300 or a term of
imprisonment not to exceed 30 days, or both.
Chapter 135 of the Code of the Borough of Economy, titled "Peddling
and Soliciting," is hereby repealed entirely.
