This article is enacted pursuant to and in accordance with the provisions of:
A. 
Subdivision 15 of § 271 of the Town Law of the State of New York,
B. 
Chapter 365 of the Laws of 1976 which added a new Subparagraph (3) to Paragraph d of Subdivision 1 of § 10 of the Municipal Home Rule Law of the State of New York, and
C. 
Other applicable provisions of law.
In order to permit the Town of Maine Planning Board (hereinafter "Planning Board") to transact business in the event that a conflict of interest, illness or absence precludes a full membership of seven members from considering a particular matter before it, § 271 of the Town Law of the State of New York is hereby amended and superseded in its application to the Town of Maine by adding thereto and inserting therein a new subdivision, to be designated Subdivision 17, to read and provide as follows:

The Town Board (hereinafter "Town Board") of the Town of Maine hereby establishes three alternate Planning Board positions for purposes of substituting for a Planning Board member in the event such member is unable to participate because of a conflict of interest, because of illness, or because of the absence of such member.
The Town Board may, in any year it deems it to be necessary, appoint alternate members of the Planning Board. Alternate members of the Planning Board shall be appointed by resolution of the Town Board, for a one-year term of office. The number of alternate Planning Board members so appointed pursuant to this section in any year shall not exceed three.
The Chairperson of the Planning Board may designate an alternate member to substitute for a Planning Board member when such member is unable to participate because of (A) a conflict of interest on an application or matter before the Planning Board, (B) the illness of such member, or (C) the absence of such member. When so designated, the alternate member shall possess all the powers and responsibilities of such member of the Planning Board. Such designation shall be entered into the minutes of the initial Planning Board meeting at which the substitution is made.
All provisions of § 271 of the Town Law relating to Planning Board member training and continuing education, attendance, conflict of interest, compensation, eligibility, vacancy in office, removal, and service on other boards shall also apply to alternate members.
