For the purpose of this Code, and in the interpretation and application of all other ordinances heretofore or hereafter adopted, except as the context may otherwise require:
BOROUGH
The Borough of Fair Lawn in the County of Bergen and State of New Jersey.
BOROUGH COUNCIL or COUNCIL
The Borough Council created and constituted pursuant to the charter.
CHARTER or BOROUGH CHARTER
The Municipal Manager form of government law pursuant to N.J.S.A. 40:69A-81 et seq.
CLERK or BOROUGH CLERK
The Municipal Clerk appointed pursuant to law.
DEPARTMENT
An organizational unit of the government established or designated by ordinance or this Code as a department, together with any agency or instrumentality of the government assigned to such organizational unit by the Borough Council.
LICENSED
Licensed in accordance with the appropriate section or chapter of this revision.
MANAGER
The Borough Manager appointed pursuant to the Charter.
MONTH
A calendar month unless otherwise specifically provided.
ORDINANCE
Any act of local legislation heretofore or hereafter adopted, and including this Code, so long as it is adopted by the procedure required for the adoption of an ordinance and so long as it remains in force and effect pursuant to law.
PERSON
Any individual, natural persons, partnerships, joint ventures, societies, associations, clubs, trustees, trusts, corporations or unincorporated groups; limited liability corporations, limited liability partnerships; or any officers, agents, employees, servants, factors or any kind of personal representatives of any thereof in any capacity, acting either for himself or for any other person, under either personal appointment or pursuant to law.
STREET
Includes a street, avenue, road, alley, lane, highway, boulevard, concourse, driveway, culvert, sidewalk and crosswalk, and every class of road, square, place or municipal parking field used by the general public.
YEAR
A calendar year unless otherwise specifically provided.
A. 
For the purpose of this Code and any other ordinances heretofore or hereafter adopted, except as the context may otherwise require:

The present tense includes the past and future tenses and the future, the present.
C. 
Any reference to gender shall include the masculine, feminine or neuter.
D. 
Any reference to the singular number includes the plural and the singular.
E. 
"Shall" is mandatory and "may" is permissive.
F. 
The time within which an act is to be done shall be computed by excluding the first and including the last day, and if the last day is a Sunday, a legal holiday or a day on which the offices of the Borough are closed by state mandate or presidential or gubernatorial executive order, that day shall be excluded.
G. 
"Writing" and "written" shall include printing, typewriting and any other mode of communication using paper or similar material which is in general use, as well as legible handwriting. Electronic communication is included in this definition.
H. 
Whenever a specific time is used in this Code, it shall mean the prevailing and established time in effect in the State of New Jersey during any day in any year.
I. 
Any citation of a statute, law or ordinance contained in this Code shall be deemed to refer to such statute, law or ordinance as amended, whether or not such designation is included in the citation.
J. 
"Chapter" shall mean one of the major divisions of this Code identified by an Arabic numeral and divided by subject matter.
K. 
"Section" shall mean a major subdivision of a chapter.
L. 
"Subsection" shall mean a subdivision of a section, identified by the letters A, (1), (a), etc.
M. 
Whenever in any place in this Code service of notice is required to be made by registered mail, such service shall have been properly and sufficiently made if effected by personal service, by certified mail, return receipt requested, or by leaving a copy at the usual place of abode of an individual with a person over the age of 14 years and in the case of an entity, by leaving a copy at a regular place of business of such entity with a person over the age of 14 years. The return of such return receipt by proper postal authorities, with the signature of the addressee on such receipt shall be deemed proof of such notice.
