The provisions of N.J.S.A. 40A:14-108 for hours of employment of policemen are herein specifically adopted and made a part hereof. The hours of employment of the uniform members of the Police Department of the Borough shall not exceed eight consecutive hours in any one day nor 40 hours in any one week, provided that in case of an emergency the officer or other official having charge or control of the Police Department shall have full authority to summon and keep on duty any and all such members during the period of emergency, provided further, that permission of the Borough Manager or Acting Manager shall be required before any member may be assigned to emergency duty outside of the Borough limits except in such instances where such emergency duty is required by county, state or federal authorities. The Borough Manager, after consultation with the Chief of Police, shall submit recommendations to the governing body concerning attendance, holidays, vacation, sick and other leaves of absence for the members of the Police Department, and all such regulations as adopted shall be in effect until the same may be amended or supplemented by resolution of the Borough Council.

A. 
Pursuant to N.J.S.A. 40A:14-123.1a, the Borough hereby classifies all duly qualified applicants for a position in the Fair Lawn Police Department as follows:
(1) 
Classification I: Residents of Fair Lawn;
(2) 
Classification II: other residents of Bergen County;
(3) 
Classification III: other residents of the State of New Jersey; and
(4) 
Classification IV: all other qualified applicants.
B. 
The Borough shall first appoint all of those applicants in Classification I and then those in each succeeding class in the order before-listed. For the purpose of residence and for initial permanent appointment, applicants must maintain continuous residency in Fair Lawn from the closing date of the open competitive announcement through the date of appointment.
Patrolmen shall be paid for their hours of employment in accordance with the salary ordinance of the Borough on a straight time basis while on a regular tour of duty or during overtime assignments except as qualified by § 33-21. A patrol officer may, with the permission of the Chief of Police be entitled to take compensatory time off from his/her regular tour of duty in lieu of cash wages. Sergeants and Lieutenants of the Police Department are not to be compensated for extra hours of employment which may be demanded of them following completion of their regular tours of duty, unless directed to do so by the Manager or Chief of Police. In the event, however, either a Sergeant or Lieutenant of police shall be required to report for duty at any time prior to his/her regular tour of duty or shall be called upon to perform extra duty in cases of emergency, then and in either of said cases they shall be entitled to additional compensation, but only on a straight time basis. The Chief of Police and Captain of Police shall not be entitled at any time to overtime compensation.
