All municipal parks, playgrounds, swimming pools
and other recreation facilities shall be under the supervision of
the Superintendent of Recreation with the approval subject to control
of the Borough Manager.
A. Use of the parks, playgrounds, swimming pools and
other recreational facilities shall be subject to approval of the
Superintendent and, except when participating in individual or group
recreation, under direction of a duly authorized director or assistant.
No person or persons shall use such facilities without having obtained
written use for such facilities from the Superintendent or his/her
agent.
B. There shall be a fee, as set from time to time by resolution of the Borough
Council, per hour, for a bathroom attendant when a permit is obtained
for a picnic.

A. The parks, playgrounds, swimming pools and other recreational
facilities shall be opened on such days and during such hours as shall
be determined by the Superintendent of Recreation with approval of
the Borough Manager. No person or persons shall enter or use such
facilities except on such days and such hours that the facilities
are opened to the public.
B. The following designated parks shall close 1/2 hour
after sunset except as hereinafter indicated:

(7) Center. Upon the issuance of a special permit by the
Superintendent of Recreation and Parks for football practices during
the months of September, October and November, the closing time of
Center Park can be extended as determined by the aforesaid Superintendent.
C. The following designated parks having lighting facilities
shall close at 11:00 p.m.:

Membership for the use of pool facilities shall
be restricted to Fair Lawn residents, borough property owners and
persons owning and operating a full-time business or professional
service within the borough and borough employees. Business and professional
service owner/operators are restricted to purchase of membership for
owner/operators, spouses and their minor children. The Superintendent
of Recreation or his/her agent shall be empowered to require such
proof of compliance with this section as he/she deems necessary. No
adult or family membership tags may be purchased by children under
the age of 18 years.
Use of pool and beach areas is limited to those
persons who hold current memberships in good standing or their registered
guests. Preschool children (under fifth birthday) must be under the
supervision of an adult member in good standing, or a registered guest.
A. The annual membership fees and other charges to permit
the use of parks, playgrounds, swimming pools and all other municipally
operated recreation facilities shall be provided by ordinance, as
set from time to time by the Borough Council.

B. Nonswimmer membership badge.

(1) Any person who is a Fair Lawn resident and 62 years
old or older who will not be entering the water, including but not
limited to wading, standing or swimming in the swimming pools, must
obtain a nonswimmer membership badge which must be worn at all times
while at the facility.

(2) Non swimmer tags may be recalled by the Superintendent of Recreation or his/her authorized agent for failure to observe park regulations or any section of this chapter and be subject to the penalties provided in §
160-17.
C. Fees shall be charged for recreation programs as
set from time to time by resolution of the Borough Council.

D. Fair Lawn Recreation/Community Center.

(1) Fees, as set from time to time by ordinance of the
Borough Council, shall be charged to any individual or group who or
which wishes to use the Fair Lawn Recreation/Community Center.
(2) A fifty-percent deposit, insurance certificate and,
if applicable, proof of nonprofit status are due at the time of contract
signing.
(3) Cancellation policy. All funds are nonrefundable 30
days before a scheduled event.
(4) Fair Lawn civic/service organizations will have free
use of the facility Monday through Thursday, 6:30 p.m. to 10:00 p.m.,
based upon a policy set forth by the Borough Manager.

Any person in the water or upon the beach or
back beach areas as prescribed by the Park Supervisor, except preschool
children (under fifth birthday), shall have prominently displayed
in plain sight at all times either a membership or a guest tag properly
registered in their name.
A sum as set from time to time by resolution
of the Borough Council shall be deposited by each guest, redeemable
upon return of guest tag. Members may be limited at any time to one
guest per day as the Park Supervisor deems such procedure to be advisable.
Members shall accompany their guests to obtain these tags and member
must remain and be responsible for guest. All guest tags shall be
returned to the bathhouse before closing time on the date for which
they were issued.
The sale of all beverages, food products or
any other commodity shall be prohibited on borough property except
by such person or persons who are granted permission by the Borough
Manager or Superintendent of Parks and Recreation and who have first
secured the necessary health cards and health certificates.
Membership or guest tags may be recalled by the Superintendent of Recreation or his/her authorized agent without refund of membership or guest fees, in case of failure to observe park regulations or any section of this chapter or if false information is given in registering for membership. Any person using a badge registered in the name of another or who shall knowingly assist in obtaining a badge for an ineligible person by means of fraud, deceit or misinformation shall be subject to the penalties provided in §
160-17.

Lost membership tags may be replaced by repurchasing
at the current price up until July 31; from August 1 until the end
of the current pool season, a replacement tag may be purchased at
half price as adult or junior membership.

A. Bicycles, wagons, carriages and other conveyances, ball playing and
any form of glass, particularly bottles, shall not be permitted on
the beach area.
B. No person shall operate any motor vehicle, bicycle, skateboard or
scooter on the street hockey courts, and there further shall be no
soccer playing on the street hockey courts.
C. No person shall operate any bicycle, skateboard, scooter or rollerblades
on the tennis courts, and there shall further be no baseball or soccer
playing or any other sport activity on the tennis courts except for
tennis.
D. Smoking; possession of tobacco and vapor products.
(1) No person shall smoke any tobacco or vapor product, including but
not limited to cigarettes, cigars and pipes, nor shall any person
possess such tobacco or vapor product in his or her hand or mouth
in a manner which outwardly appears to be an act of smoking and regardless
of whether the tobacco or vapor product is lit or unlit on any outdoor
municipal public park, recreation area, senior center and community
center.
(2) For purposes of this subsection, "outdoor municipal public park,
recreation area, senior center and community center" shall be defined
as any public park, playground, ball field, senior center, community
center or pool owned or leased by or situated within the Borough of
Fair Lawn upon which the public is invited or upon which the public
is permitted and where individuals may gather for any recreational
activity, including areas adjacent to such areas such as parking areas,
driveways, or drive aisles.
(3) Insofar as this subsection may be applicable to property owned by
the Borough of Fair Lawn Board of Education, and insofar as this Code
construes the provisions of this subsection as being applicable to
parks, ball fields or recreation areas owned by the Board of Education,
the provisions of this subsection shall apply to property owned by
the Fair Lawn Board of Education to the extent it is not expressly
superseded by any state statute or Board of Education rule or policy
adopted expressly in furtherance of state statutes providing for the
prohibition of smoking on school properties.
E. Private
lessons on any public tennis, pickleball, basketball or hockey court
for money or other valuable compensation is prohibited, except for
instruction sponsored or approved by the Superintendent of Recreation
or designee.

Eating and smoking on the beach is prohibited.
Food stuffs may be consumed only in designated areas where picnic
tables are provided. Use of beach umbrellas, tables, chairs, etc.,
shall be used in such areas as permitted by the Park Supervisor, and
no fire shall be started except in designated areas and with a fire
permit.

Free pool passes shall be issued, through the
Department of Health and Human Services, to disabled individuals who
meet predetermined criteria as to age, disability and income.
The Health Officer or the Superintendent of
Recreation may, with the consent and approval of the Borough Manager,
whenever in their judgment such action is deemed necessary for the
protection and health of the persons entitled to use of such facilities,
close the pool, and no membership or guest fee shall be refunded upon
such closing, except by the direction of the Borough Manager.

A. Dogs shall be permitted in any Borough park, as long as such dog
is accompanied by a person over the age of 12 years, is securely controlled
by an adequate leash that is of sufficient strength to hold the dog
not to exceed six feet in length and remains on the leash at all times.
B. No person owning, keeping or harboring any dog shall be permitted
to be upon or in any Borough sports fields, playground areas, beaches,
including the grass area within the perimeter fence that surrounds
Memorial Pool, the arboretum or park buildings.

C. It shall be unlawful for any person owning or having charge, care,
or custody of any dog in a Borough park not to immediately pick up
and properly dispose of the feces of such dog. Dog waste shall be
immediately removed by placing said matter in a closed or sealed container
and thereafter disposing of it in a trash receptacle, sanitary disposal
unit or other closed or sealed refuse container.
The Borough Manager, members of the Borough
Police Department, the Superintendent of Recreation, the park or playground
supervisor and such special policemen or lifeguards who are on duty
at the facility shall have authority to prohibit any action or conduct
which they consider to be dangerous, improper or immoral, and any
such action or conduct shall be prohibited by this chapter even though
not specifically mentioned herein.
Any person, firm or corporation violating any of the provisions of this article shall, upon conviction thereof, be liable to the penalty stated in Chapter
1, General Provisions, Article
III.
