The Borough Manager is hereby empowered from
time to time at his/her discretion to determine whether there is an
adequate amount of water in the municipal water supply system to permit
the sprinkling or watering of lawns, trees, gardens or shrubbery;
or for the use of washing of cars or other nonhousehold purposes;
and if a state of emergency exists in the supply of water, to prohibit
the use at any time by any persons in the Borough of Fair Lawn of
water drawn from the municipal supply system for these purposes, or
to fix certain days and hours within which water can be used for these
purposes.
The Borough Manager shall give due publicity to such regulations prohibiting or regulating the use of municipal water for the purposes outlined in §
241-45 as may be deemed necessary by him/her, and any person who violates these regulations shall be deemed to have violated the provisions of this chapter.
Any person, firm or corporation violating any of the provisions of this article, or any regulation promulgated hereunder, shall, upon conviction thereof, be liable to the penalty stated in Chapter
1, General Provisions, Article
III.
This section is declared and determined by the
Council to be necessary for the immediate preservation of public health
and safety and to remedy an emergency caused by the inadequacy of
water supply.
