The Construction Official of the Borough shall
also be known as the "Zoning Officer" and shall have the additional
powers and duties set forth in this article.
The duties of the Zoning Officer shall be as
follows:
A. Review all applications for development to ensure
they meet the requirements of this chapter, except for those sections
where another official is specifically given enforcement or administrative
responsibilities.
B. Discover and ascertain the existence of any violations
of the Borough Zoning Ordinance, Site Plan Ordinance or Subdivision
Ordinance.
C. Investigate and inspect any alleged violation of the
Borough Zoning Ordinance, Site Plan Ordinance or Subdivision Ordinance.
D. Prevent further or continued violations of the Borough
Zoning Ordinance, Site Plan Ordinance or Subdivision Ordinance which
are known by him/her to exist, and by every lawful means cause the
violators to cease and desist from committing such further violations.
E. Prosecute violations of the Borough Zoning Ordinance,
Site Plan Ordinance and Subdivision Ordinance in the manner provided
by law.
F. Make an inspection of every parcel of land, building
or structure for which a development application is requested in order
to ascertain that said occupancy or use will comply with every standard,
regulation and requirement of the Borough Zoning Ordinance, Site Plan
Ordinance and Subdivision Ordinance for such occupation and use.
G. Issue zoning permits, which shall be required as a
condition precedent to the commencement of a use or the erection,
construction, reconstruction, alteration, conversion or installation
of a structure or building, where an existing or proposed occupancy
or use complies with every standard, regulation and requirement of
the Borough Zoning Ordinance, Site Plan Ordinance and Subdivision
Ordinance.
H. Report to and advise the Planning Board and Board
of Adjustment with respect to matters which are properly before each
Board, and otherwise conduct investigations with respect to matters
pertaining to the Borough Zoning Ordinance, Site Plan Ordinance, Subdivision
Ordinance and otherwise within his/her jurisdiction.
I. Initiate and maintain an accurate and complete file
with respect to every alleged zoning violation or other matter investigated
and processed by him/her.
J. File reports of his/her activities, including the
complaints and case processed by him/her and the disposition thereof
with the Borough Council as may be directed by them.
K. Serve notice upon the owner of any property found
in violation of the Borough Zoning Ordinance, Site Plan Ordinance
or Subdivision Ordinance and, if said violation is not corrected within
30 days thereof, prosecute a complaint to terminate said violation
in Municipal Court.
L. Determine compliance with conditions of approval set
forth in resolutions adopted by the Planning Board or Board of Adjustment,
serve notice upon the owner of any property found to be in violation
thereof and, if said violation is not corrected within 30 days thereof,
prosecute a complaint to terminate said violation in Municipal Court.
