A.
No structure, as defined in § 410-7 of the Zoning Chapter, shall be constructed in any Borough right-of-way.
B.
In the event a property owner desires to install a
water sprinkling system or any part thereof in the Borough's right-of-way,
the property owner shall make application to the Building Department
and pay a fee of $25 for administrative review and approval.
C.
The property owner shall execute, as a condition to
receiving permission to install such watering system, an indemnification
and hold harmless agreement in favor of the Borough and an acknowledgment
that the owner and his successors in interest shall at all times be
responsible for any damages occasioned by such sprinkler system. The
agreement shall also acknowledge the fact that the Borough shall not
be responsible for damage to such system in the event the Borough
is called upon to conduct repairs or maintenance in the right-of-way.
