As provided by N.J.S.A. 39:4-139.2 et seq., the Borough of Fort Lee,
by adoption of this chapter, authorizes the impoundment or immobilization
and possible sale of a vehicle found within the jurisdiction of the municipality
if there are any outstanding warrants against the vehicle or its owner for
parking violations.
As used in this chapter, the following terms shall have the meanings
indicated:
PARKING VIOLATIONS
A violation of a state statute, an ordinance or resolution adopted
by a county, municipality or authority or a regulation issued by a state authority
which regulates the parking of vehicles.
VEHICLE IMMOBILIZATION
To place a mechanical device around one or more of the wheels of
a vehicle which prevents the vehicle from being driven away.
VEHICLE IMPOUNDMENT
To remove a vehicle from the public streets or private property (with
the permission of the owner of the private property) and place said vehicle
in a storage yard.
Where an individual has failed to appear in the Fort Lee Municipal Court
in response to a parking summons; and has failed to respond to a failure-to-appear
notice from the Municipal Court; and has not satisfied the parking summons
penalty and court fines; and an arrest warrant has been issued from the Municipal
Court against the vehicle owner for the failure to appear and/or satisfy the
penalties and/or court fines, then the vehicle may be impounded or immobilized
upon the authority of a police officer, special police officer, or Parking
Authority enforcement officer.
In addition to any parking summons penalty and fines or court costs
assessed by the Municipal Court, the vehicle owner shall pay to the Parking
Authority through the Municipal Violations Bureau or Court the following fines
prior to release from immobilization or impoundment:
A. Vehicle immobilization: $75 for the installation and
removal of an immobilization device.
B. Vehicle towing: $75 for the towing of a vehicle to an
impoundment storage yard.
C. Vehicle storage: $2 per day (in addition to the storage
yard's customary daily charge).
D. Vehicle sale: $150 for the costs associated with the
sale of a vehicle.
If the outstanding warrants are not paid by 12:00 midnight of the 30th
day following the day of which the vehicle was impounded or immobilized, the
vehicle may be sold at a public auction as provided by N.J.S.A. 39:4-139.13a,
b, c and d.
