The purpose of this chapter is to provide regulations to residential,
commercial, industrial and other users of the garbage collection system in
the Borough of Gibbsboro so that all persons are obliged to place their garbage
and trash in adequate containers, at suitable locations and at designated
times. This chapter shall also provide penalties upon conviction for violation
of any of the provisions set forth herein.
For the purpose of this chapter, certain words and phrases are defined
as follows:
Except as otherwise specifically provided herein, containers used
for storing garbage or trash which are galvanized or plastic cans, having
handles and tight-fitting covers, or suitable plastic trash bags securely
tied; and any such can or bag shall have a capacity of from 10 to 40 gallons
and shall weigh no more than 50 pounds when filled.
Include all forms of solid or semisolid waste materials discarded
by persons in Gibbsboro Borough and shall include garbage, offal, rubbish,
any decaying or vegetable substance or other refuse, including any waste or
worthless matter.
Includes a person of either sex and shall pertain to any natural
person or association of persons, including but not limited to a partnership,
individual proprietorship or corporation, or other business entities recognized
by the law of the State of New Jersey.
A.Â
All garbage and trash intended for collection shall be
drained of all free liquid and shall be wrapped or sacked and then placed
in containers. Other forms of garbage, not containing any form of free liquid,
such as newspapers, magazines, collapsible cardboard boxes or other containers
must be set out in securely tied bundles and not placed in a container, provided
that no one bundle shall exceed 50 pounds in weight. Such rubbish may also
be placed in a container with garbage, provided that the combined weight of
such trash does not exceed 50 pounds in weight.
B.Â
It shall be unlawful for any person to place garbage
for collection that is not drained of liquid or semiliquid substances, and
the same shall not be collected whether in an approved container or not. All
garbage and rubbish constituting the trash to be collected must be stored
and maintained in a sanitary condition until picked up by those agents or
employees designated by the Borough for such task.

All persons who own or occupy property shall be responsible
for placing their trash at the curb abutting their property in the proper
containers, and this shall be done on the day designated for collection, but
no sooner than 4:00 p.m. on the day preceding the day of collection, and,
thereafter, empty containers shall be removed by said persons no later than
7:30 p.m. on the day of collection. All containers must be stored 25 feet
from the curbline.
D.Â
Trash dumpsters used to service apartment complexes,
townhouses or condominiums shall be placed at least 25 feet from the curbline
and must be maintained in sanitary condition.

A.Â
The Borough, by its designated agents, contractor and
employees, may collect and remove, weekly, only the household matter described
herein when such matter is placed into proper receptacles or bundles and placed
for collection in the manner prescribed.
B.Â
The Borough shall have the right to omit collections
from any premises where a dog is permitted to run at large.
C.Â
No agent, contractor or employee of the Borough shall
be required to enter into any building or structure to gather or collect refuse
or garbage, nor is any agent, contractor or employee of the Borough authorized
to solicit money for any purpose in connection with the Borough's collection.
D.Â
The Borough and or its contractor shall make no return
calls for refuse not placed out at the curb on time nor for refuse not placed
out at the rear in time.
E.Â
Collections may not be made on legal holidays.
F.Â
By law, refrigerator and freezer doors must be removed,
when placed at the curb, for children's safety.
G.Â
Branches, hedge trimmings, light brush clippings, etc.,
must be securely tied into three-foot bundles that can be easily handled,
and the diameter of any branch may not exceed six inches. Said bundles shall
not exceed 50 pounds in weight. Bulk items such as automobile equipment, tree
stumps, building materials, fences, demolition materials, stone or dirt shall
not be subject to collection and removal by the Borough, its agents, contractors
or employees.
H.Â
The Borough of Gibbsboro shall not be responsible for
the collection of any garbage or trash as herein defined from any industrial
enterprise, commercial business, store, shop or apartment house which contains
more than three dwelling units.

The provisions of this chapter shall be enforced by the Code Enforcement
Officer of the Borough of Gibbsboro.
