As used in this article, the following terms shall have the meanings indicated:
CHILD-CARE FACILITIES
Includes every private child-care center, infant-care center, day nursery, nursery school, boarding school, private elementary school, cooperative group, play group or other establishment of similar character for the care or schooling of six or more children under six years of age, in which any tuition, fee, board or other form of compensation is charged or which is publicly funded, whether or not tuition fees, board or other form of compensation is charged.
A. 
No person shall maintain any place for the day care of children in the city unless a license therefor has first been issued by the Health Department in accordance with the provisions of Chapter 107, Licenses and Permits.
B. 
The requirements set forth in this Article are not intended to conflict with any state and federal requirements. All applicable state and federal requirements must be fulfilled.
C. 
Licenses shall not be required for public or parochial schools if such places comply with all other regulatory requirements of this Article, relevant laws and regulations.
A. 
In addition to the information required to be contained in applications under the provisions of § 107-6B of Chapter 107, applications for a license under this Article shall:
(1) 
State the number of children to be accommodated.
(2) 
Give evidence of the financial ability of the applicant to comply with all provisions of this Article, including sufficient liability insurance.
(3) 
Contain a detailed description of the structure or premises to be used for such purposes, and the location thereof.
(4) 
List names, titles and qualifications of personnel.
B. 
A license shall only be issued for a place where children are given day care if the Chief of the Bureau of Fire Prevention and the Construction Official have indicated their approval of the facility in writing on the application form.
(1) 
The initial license shall only be issued for a place where children are given day care, provided that the Construction Official has indicated his approval of the facility by the issuance of a certificate of occupancy or a certificate of continued occupancy.
(2) 
Renewal of a license shall only be issued after written approval has been given by the Building Subcode Official and the Fire Subcode Official.
License cards issued under this Article shall state the name of the licensee, the address of the premises and the maximum number and age groups of children permitted. The license shall be posted in a conspicuous place on the premises at all times.
A. 
A properly identified representative of the local Health Department shall have the right to entry for inspection during all normal business hours of the center.
B. 
In order to provide for the proper administration of all relevant standards, regulations and requirements, annual inspection fees, payable to the Health Department of the City of Hackensack on or before March 1 of each year, are as follows:

Any person, firm, corporation, partnership or association found to be in violation of this chapter shall be subject to the penalties set forth in Chapter 1, § 1-15, of the Code of the City of Hackensack, New Jersey.

No person or agency shall receive, board or care for any child under the age of 16 years in the city except in conformity with Chapter VI, Boarding Homes for Children, of the New Jersey State Sanitary Code, and unless a license therefor has first been issued by the Health Department in accordance with the provisions of said chapter.
Licenses shall not be required for boarding schools meeting the requirements of the New Jersey State Department of Public Instruction as to compulsory education.
