This article shall be known and may be cited
as the "Road Acceptance Ordinance of the Township of Hanover, Morris
County, New Jersey."
The purpose of this article shall be to provide
rules, regulations and standards to govern the construction of roads
and public improvements and as a guide for the acceptance of roads
and public improvements in the Township of Hanover, Morris County,
New Jersey, in order to promote the comfort, health, safety, convenience
and general welfare of the Township in conformance with the Township's
Subdivision Regulations, Zoning Ordinance and Official Map.
The provisions of this article shall be administered
by the governing body after favorable referral by the Planning Board,
and/ or the Township Engineer of the Township of Hanover.
No street which has heretofore or which may
hereafter be dedicated to public use, and no accepted street, shall
hereafter be constructed or reconstructed unless the same shall be
designed and constructed in accordance with this article.
Before any road is constructed or reconstructed
or other public improvements installed, by other than the Township
of Hanover, the owner of the property or the developer shall make
application, in writing, for a permit, specifying the nature of the
opening or improvement which is to be made, and shall provide satisfactory
evidence to the Township Committee that approval for such a road or
other public improvement has been granted by the Planning Board.
The Township Engineer shall review the plans
for new road construction, road reconstruction or other public improvement
construction and shall prepare a detailed cost estimate of the improvements.
The governing body shall not take any favorable action on any application
for new road construction or road reconstruction or other public improvement
construction until it has received and reviewed a cost estimate of
the project from the Township Engineer. A surety bond, in a form and
amount satisfactory to the Township, may be required by the governing
body if and when necessary.

Engineering requirements and specifications
for any such street shall be as contained in the Standard Specification
for Road and Public Improvement Construction for the Township of Hanover,
Morris County, New Jersey, prepared by the Township Engineer. This
document, in its entirety, is hereby incorporated by reference in
this article and made a part hereof, and copies shall be available
at the office of the Township Engineer. Said requirements and specifications
shall be considered minimum requirements.

Any person, partnership, corporation or association
or any member thereof or officer of same who violates or causes, suffers
or permits the violation of this article or any part thereof shall,
upon conviction thereof, pay a fine not exceeding $1,000 for each
offense or be imprisoned for a term not exceeding 90 days, or both,
in the discretion of the Judge before whom such conviction shall be
had.
