State regulations, specifically N.J.A.C. 5:23-2.15(a)5
and 5:23-1.4, require that, prior to the issuance of a construction
permit, it be demonstrated to the Construction Official that all local
prior approvals have been obtained. The practice of the state enforcing
officials, pursuant to such state regulations, is to require, before
issuing certain construction permits, a certification from the Township
that all local prior approvals have been obtained. This involves research
of Township records and municipal administrative expense in making
such certification. This chapter is designed to provide a fee to defray
such expense and to provide for a specific method of rendering the
required certification to the Construction Official.
Whenever a request to the Township is made for a prior approval certification pursuant to the above-mentioned state regulations, the request for such certification shall be made to the Development Regulations Officer of this Township. A fee, as established in Chapter
83, Fees, payable to the Township, shall accompany the request for such certification. The Development Regulations Officer, upon receiving such request, accompanied by such fee, shall examine pertinent Township records and make such inquiries as are appropriate, with regard to the prior approvals defined by N.J.A.C. 5:23-1.4, pertinent to the application involved. If all prior approvals have been obtained, the Development Regulations Officer shall issue a certification to that effect to the Construction Official. If all prior approvals have not been obtained, the Development Regulations Officer shall report the same, in writing, to the Construction Official, detailing the approvals not obtained. The Development Regulations Officer may, at the discretion of such Official, establish certain application and/or certification forms for use in carrying out this procedure.
