The Municipal Court is hereby created and established pursuant
to N.J.S.A. 2B:12-1 et seq., and by Rule 7:1 et seq. The Municipal
Court shall be presided over by the Judge of the Municipal Court.
The name of the Municipal Court shall be the "Municipal Court
of the Township of Holland in the County of Hunterdon."
The Municipal Court shall have an official seal which shall
bear the impress of the name of the Court.
There shall be one Judge of the Municipal Court, who shall be
appointed by the Township Committee for a term of three years from
the date of their appointment and until their successors are appointed
and qualified.
In the event that the Judge of the Municipal Court is unable
to perform his/her duties, due to either illness, absence, or physical
and/or mental disability, the Court Administrator shall select a Municipal
Court Judge from a list established by the Assignment Judge to serve
as a Temporary Acting Judge of the Municipal Court during the period
of incapacity of the Judge.
The Municipal Court and the Municipal Judges thereof shall have,
possess, and exercise all the functions, powers, duties and jurisdiction
which are or may be conferred by general law and the applicable rules
of the Supreme Court of New Jersey.
There shall be a Municipal Court Administrator who shall be
appointed by the Township Committee. They shall perform such functions
and duties as shall be prescribed by law, the rules applicable to
Municipal Courts of the State of New Jersey and by the Judge of the
Municipal Court (N.J.S.A. 2B:12-10).
The Municipal Court shall be held in the location designated
in the applicable shared service agreement. The Municipal Judges shall
sit at such times as the business of the Court may require, subject
to the rules of the New Jersey Supreme Court applicable to municipal
courts.
