This chapter is for the purpose of regulating
the hours of sale, service and delivery of alcoholic beverages and
fixing license fees for alcoholic beverage licenses in the Township,
in accordance with N.J.S.A. 33:1-1 et seq. and the rules and regulations
promulgated by the New Jersey Division of Alcoholic Beverage Control.

No licensee shall sell, serve, deliver, or allow, permit or
suffer the sale, service or delivery of, any alcoholic beverages on
the licensed premises on weekdays and Saturdays between the hours
of 2:00 a.m. and 7:00 a.m. or between the hours of 2:00 a.m. Sunday
and 11:00 a.m. Sunday, except on New Year's Day when the sale,
service or delivery of alcoholic beverages shall be permitted until
3:00 a.m.; and except for Christmas Eve and Christmas Day if said
days fall on a Sunday between the hours of 2:00 a.m. and 10:00 a.m.

The following fees shall be as established in Chapter
83, Fees:
A. The annual fee for a club license for the sale of
alcoholic beverages.
B. The annual fee for a plenary retail distribution license
for the sale of alcoholic beverages.
C. The annual fee for a plenary retail consumption license
for the sale of alcoholic beverages.

No person shall be intoxicated by reason of
consumption of an alcoholic beverage in the right-of-way of any public
street in this Township which is maintained by the Township or the
County of Hunterdon or on lands or in buildings owned by the Township.
No person shall consume, or carry or have in his possession, any opened
container containing any alcoholic beverage:
A. In the right-of-way of any public street in this Township
which is maintained by the Township or the County of Hunterdon; or
B. On any lands or in any building owned by the Township,
except on lands or in buildings leased to a third party or except
when such opened container is served or available to such person as
part of a social or similar event sanctioned or approved by the Township
which has received a proper license from the Division of Alcoholic
Beverage Control, if such license is required.

A. The governing body may prescribe penalties for the
violation of ordinances it may have authority to pass, either by imprisonment
in the county jail or in any place provided by the municipality for
the detention of prisoners, for any term not exceeding 90 days or
by a fine not exceeding $1,000, or both. The court before which any
person is convicted of violating this chapter shall have power to
impose any fine or term of imprisonment not exceeding the maximum
fixed in this chapter.
B. Any person convicted of the violation of this chapter
may, in the discretion of the court by which he was convicted, and
in default of the payment of any fine imposed therefor, be imprisoned
in the county jail or place of detention provided by the municipality
for any term not exceeding 90 days.
