Its Fire Department shall be made available to the
Township of Lopatcong for the purpose of fire protection and emergency
management, including personnel and equipment, as the Township of
Lopatcong may require upon request to the Fire Chief or his designate
provided. However, services shall not be provided as a result that
it would cause the Town of Phillipsburg Fire Department to become
undermanned or would interfere with the efficient operation of said
Fire Department.
Each party hereto shall not incur any insurance obligations other than for their own respective personnel and equipment, and each party hereby agrees to hold the other harmless and indemnify the same from any and all claims which may arise from either one of the parties hereto responding to a request made pursuant to Subsections A(1) and B of the within agreement.
In the event that a request is made pursuant to this
agreement for aid by either party hereto, the responding firefighters,
together with their equipment, shall be and shall remain under the
direction, control and authority of their own employer-municipality;
however, the responding party shall obey the official in charge at
the scene to which the responding party has been summoned.
The respective municipalities may meet upon call for
the selection of necessary officers and personnel or for such other
matters as are mutually deemed necessary. All such meetings shall
be in accordance with the Open Public Meetings Act.[1]
