As used in this chapter, the following terms
shall have the meanings indicated:
COMMERCIAL LANDSCAPER
A person or entity whose business involves the placing, planting,
arranging, trimming, cutting and removing of trees and the maintenance
of lawns, trees, bushes, shrubs, gardens and related appurtenances
on land or property for the purpose of improving the same.
VEHICLE
Every device in, upon or by which a person or property is
or may be transported upon a highway.
The application for a permit to operate or conduct
business as a landscaper in Margate City shall be made, in writing,
to the City Clerk and signed by the applicant. The application shall
set forth:
A. The name, address and telephone number of the applicant.
B. The character and type of the substance, e.g., grass
clippings, brush, twigs or leaves, that the applicant will be dumping
in his operation.
C. The location where the debris is to be taken and the
name and telephone number of the company or organization to receive
such debris.

A. Every commercial landscaper operating in Margate must pay a mercantile
fee in an amount set by ordinance.
B. The name of the commercial landscaping company shall be clearly indicated
on both sides of any vehicle used in said operation and the letters
shall be no less than three inches in height and shall include the
address and telephone number of the company.
C. The use of grass or leaf blowers shall be permitted, providing no
grass or leaves may be dispersed onto public property or private property
other than the property being maintained.
D. Any grass, leaves, clippings or similar debris collected from the property must be removed promptly and taken in a covered vehicle to an approved site for proper disposal unless permitted to be placed at the curb in accordance with Chapter
155, Garbage, Rubbish and Refuse.
E. Commercial landscapers shall be permitted to engage in the landscaping business only on the days and hours as permitted in Chapter
192, Noise.
Any person or persons who shall violate or fail
to comply with any of the provisions of this chapter, upon conviction
thereof, shall be punished by a fine of not less than $100 for the
first offense, not less than $100 and not to exceed $500 for the second
offense and not less than $100 and not to exceed $1,000 for the third
offense and/or the revocation of the permit to further operate within
the City of Margate City.
