This chapter shall be known and referred to
as the "Village of New Haven Subdivision Regulations."
These subdivision regulations have been enacted
for the purpose of protecting the public health, safety and general
welfare of the residents of the Village and ensuring the orderly growth
and harmonious development of the Village by requiring:
A. Proper arrangement of streets in relation to existing
or planned streets or to the Comprehensive Development Plan.
B. Adequate and convenient open spaces for traffic, utilities,
access of fire-fighting equipment, recreation, light, air, privacy
and safety from fire hazards.
C. Avoidance of population congestion.
D. Establishment of standards for the construction of
any and all improvements as herein required.
E. Establishment of standards for yard drainage.
These regulations are made, interpreted and
enforced by the Village Council and Village Planning Commission under
authority of the State of Michigan, Act 288, Public Acts of 1967,
as may be amended.
The provisions of this chapter shall be construed
to be the minimum requirements necessary for the preservation of public
health, safety and welfare within the Village. This chapter is not
intended to repeal, abrogate or supersede any existing regulations
of the Village, nor to conflict with any statutes, laws or regulations
of the State of Michigan or Macomb County, except that this chapter
shall prevail in cases where this chapter imposes a lawful restriction
or requirement more severe than existing statutes, laws or regulations.
If any section or provision of this chapter shall be held invalid,
this shall not affect the validity of other sections of provisions
hereof.
The provisions of this chapter shall become
effective upon publication of a notice of adoption by the Village
Council.
Subsequent to the effective date of this chapter,
no plat within the Village of New Haven shall be approved by the Village
Council unless it conforms to this chapter.
