No person shall cause, suffer, allow or maintain the open burning of
any combustible material on or in any public street, alley, road or other
public ground or on any private land within the Town of Southwick without
first having obtained a permit from the town's Fire Department.
No person shall cause, suffer, allow or maintain the burning of any
trash, papers, rubbish, garbage or other combustible material out of doors
within the Town of Southwick in any container, unless such container has been
approved, and a permit has been issued therefor, by the town's Fire Department.
Nothing contained herein shall authorize or allow burning which is prohibited
by rules and regulations promulgated by the Massachusetts Department of Environmental
Protection, including those rules and regulations codified in 310 CMR 7.07
et seq., as amended, or which is prohibited by MGL C. 48, § 13,
as amended.
Nothing contained herein shall be construed to prohibit, or require
a permit for, fires used for cooking purposes.
Whoever violates any provision of this chapter shall be punished by a fine of $25 for each offense. As an alternative to initiating criminal proceedings to enforce this chapter, the Chief of the Department may elect to utilize the noncriminal disposition procedures set forth in Chapter
1, General Provisions, §
1-6.
