It is the intent of this article to prohibit the infringement of any business in any established residential area and, in so doing, to regulate the term and frequency of a personal property sale, such as a garage sale, porch, basement or yard sale or other similar type of sale, so as not to disturb or disrupt the residential environment of the area.
No permit is required.
A. 
Any person desirous of holding a personal property sale, such as but not limited to a garage sale or basement, porch or yard sale for the resale of used household property, clothing or any personal property items which are owned by the residents of the premises, shall be limited to two such sales per calendar year for a maximum of three consecutive days per sale, during the hours of 9:00 a.m. to 9:00 p.m.
B. 
No signs, posters or other advertising materials shall be placed upon or attached to any public properties, such as but not limited to telephone poles, or upon public roads or highways.
A police officer or any other official designated by any Town ordinance or by the Town Board to make inspections or to enforce the same shall have the right of entry to any premises showing evidence of a personal property sale, for the purpose of enforcement or inspection, and he may close the premises from such a sale or arrest any person who violates the provisions of this article.
Each violation of this article shall be punishable by a fine of not more than $250 or by imprisonment for not more than 15 days, or both.
