This chapter shall be known as the "1988 Sewer

Definitions. The meaning of terms used in this chapter
shall be as defined in Webster's New Collegiate Dictionary as printed
in 1976, except as follows:
American Society for Testing and Materials.
Any owners of real property within the Village of Chittenango
for which sanitary sewer service is available pursuant to this chapter
and any owner of real property within the following areas: Clay Hill
Road, Wheeler Road and Sandy Hatch Road, with whom satisfactory agreements
for individual sewer service have been executed, all residents within
residential areas in municipalities within a reasonable distance of
the Village limits of the Village of Chittenango (with whom a satisfactory
inter-municipal cooperation agreement exists for the provision of
sewer services) and all owners of real property outside the limits
of the Village of Chittenango who are currently lawfully connected
to the public sewer.

The Sewer Commissioner(s) duly appointed by the Board of
Trustees.
The governing, duly elected Board of Trustees of the Village
of Chittenango or its authorized representatives. The term "Board"
used in this chapter means the "Board of Trustees."
The quantity of oxygen utilized in the biochemical oxidation
of organic matter under standard laboratory procedure in five days
at 20° C., expressed in milligrams per liter.
Any person, persons or corporation who undertakes to construct,
either under contract or for resale, any habitable building.
That part of the lowest horizontal piping of a drainage system
which receives the discharge from sanitary waste pipes inside the
walls of the building and conveys it to the building sewer which begins
five feet beyond the outer face of the building wall.
The extension from the building drain to the public sewer
or other place of disposal as established by the Village, and shall
be the responsibility of the building owner.
A sewer intended to receive both surface runoff and sewage.
Any person, persons or corporation who undertakes to construct
simultaneously more than one housing unit on a given tract or land
subdivision.
An acquired legal right for the specific use of land owned
by others.
The consulting professional engineer retained by the Village.
Water leaving the sewer system and entering into the ground
through such means as, but not limited to, defective pipes, pipe joints,
connections or manhole walls.
Solid wastes from the domestic and commercial preparation,
cooking and dispensing of food and from the handling, storage and
sale of produce.
Any liquid resulting from any process of industry, manufacturing,
trade or business or from development or recovery of natural resources.
The liquid wastes from industrial manufacturing processes,
trades or businesses as distinct from sanitary sewage.
The water entering a sewer system, including sewer service
connections, from the ground through such means as, but not limited
to, defective pipes, pipe joints, connections or manhole walls.
Any outlet into a watercourse, pond, ditch, lake or other
body of surface or ground water.
The unit charge applicable to residences located outside
the corporate limits of the Village.

New York State Department of Environmental Conservation or
duly authorized official of said Department.
New York State Department of Transportation.
Operation and maintenance of the sewage works.
The Onondaga County Water Authority or any successor thereto.
Any individual, firm, company, association, corporation,
society, person or group having title to real property.
Any individual, firm, company, association, society, corporation
or group.
The logarithm of the reciprocal of the weight of hydrogen
ions in grams per liter of solution.
That person, persons, firm or corporation performing work
under this chapter who actually installs the plumbing system.
Any water that contains substances, whether gaseous, liquid
or solid, the amount of which may contain soluble or insoluble solids
of organic or inorganic nature which may deplete the dissolved oxygen
content of natural waters, contribute solids, contain oil, grease
or floating solids which may cause unsightly appearance on the surface
of such waters or contain materials detrimental to aquatic life.
The reduction of the amount of pollutant properties in wastewater
to a less harmful state prior to or in lieu of discharging or otherwise
introducing such pollutants into a POTW. The reduction or alteration
can be obtained by physical, chemical or biological processes, process
changes or by other means, except as prohibited by 40 CFR 403.6, General
Pretreatment Regulations for Existing and New Sources of Pollution,
and any amendments thereto.
A privately owned system for the treatment and ultimate disposal
of wastewater, such as a septic tank, holding tank or other system.
The wastes from the preparation, cooking and dispensing of
food that have been shredded to such a degree that all particles will
be carried freely under the flow conditions normally prevailing in
public sewers with no particle greater than 1/2 inch (1.27 centimeters)
in any dimension.
The boundary line as a result of land ownership and/or the
street line or the edge of a sewer right-of-way.
A treatment works as defined by Section 212 of the Act (33
U.S.C. § 1292). The term includes any sewers that convey
wastewater to the POTW but does not include pipes, sewers or other
conveyances not connected to a facility providing treatment.
A sewer in which all owners of abutting properties have equal
rights and which is controlled by public authority.
Resource Conservation and Recovery Act.
The unit charge applicable to residential units within the
corporate boundaries of the Village.

All premises used only for human residency and which is connected
to the wastewater facilities.
A sewer intended to carry only sanitary or sanitary and industrial
wastewater from residences, commercial buildings, industrial plants
and institutions and to which storm-, surface and ground waters are
not intentionally admitted.
Domestic wastewater with storm- and surface water excluded
and includes wastewater discharging from the sanitary conveniences
of dwellings (including apartment houses and hotels), office buildings,
industrial plants or institutions.
A combination of the water-carried wastes from residences,
business buildings, institutions and industrial establishments, together
with such ground-, surface and storm waters as may be present.
Any arrangement of devices and structures used for treating
sewage.
A pipe or conduit for carrying sewage.
All facilities for collecting, pumping, treating and disposing
of sewage, with the exception of private sewage disposal systems.
Any industrial user of the Village's wastewater treatment
system who is:
Subject to national categorical pretreatment
standards promulgated by USEPA;
Having substantial impact, either singly or
in combination with other industries, on the operation of the treatment
works;
Using, on an annual basis, more than 10,000
pounds or 1,000 gallons of raw material containing priority pollutants
or substances of concern and discharging a measurable quantity of
these pollutants to the sewer system; or
Discharging more than 5% of the flow or load
of conventional pollutants received by a Village POTW treatment plant.
Any discharge of water, sewage or industrial waste which
in concentration of any given constituent or in quantity of flow exceeds
for any period of duration longer than 15 minutes more than five times
the average twenty-four-hour concentration or flows during normal
operation.
State Pollutant Discharge Elimination System.
The State Pollutant Discharge Elimination System discharge
permit issued by the New York State Department of Environmental Conservation.
A pipe or conduit which carries storm- and surface waters
and drainage but excludes sewage and industrial wastes other than
unpolluted cooling water.
The Superintendent of the Department of Public Works of the
Village of Chittenango or the Village's authorized representative.
Solids that either float on the surface of or are in suspension
in water, sewage or other liquids and which are removable by laboratory
filtering.
The combination of assessments and fees imposed upon each
authorized user of the sewer system by resolution of the Board of
Trustees.

Water to which no constituent has been added, either intentionally
or accidentally, which would render such water unacceptable to the
agency having jurisdiction thereof for disposal to storm or natural
drainages or directly to surface waters.
Any water or waste containing none of the following: free
or emulsified grease or oil; acid or alkali; phenols or other substances
imparting taste or odor in receiving waters; toxic or poisonous substances
in suspension, colloidal state or solution; and noxious or odorous
gases. It shall contain not more than 10,000 milligrams per liter
of dissolved solids, of which not more than 2,500 milligrams per liter
shall be as chloride with permissible volumes subject to review by
the Inspector, and not more than 10 milligrams per liter each of suspended
solids and BOD. The color shall not exceed 50 milligrams per liter.
The quantity of oxygen utilized in the ultimate oxidation
of organic matter. It shall also include satisfaction of the nitrogenous
oxygen demand, the tests for which shall be performed under standard
laboratory procedures and the results expressed in milligrams per
liter.
United States Environmental Protection Agency or duly authorized
official of said Agency.
The Village of Chittenango, New York.
The spent water of a community. From the standpoint of source,
it may be a combination of the liquid and water-carried wastes from
residences, commercial buildings, industrial plants and institutions,
together with any groundwater, surface water and stormwater that may
be present.
Any natural or man-made channel in which a flow of water
occurs, either continuously or intermittently.
Water Pollution Control Federation.

Word usage. "Shall" is mandatory, "may" is permissive.
