Before receiving endorsement on the final subdivision plat, the developer shall complete all improvements to the satisfaction of the Village Engineer or other village official as specified elsewhere in these regulations or post a performance guaranty sufficient to insure the satisfactory completion of the following required improvements, except where waivers may be requested.
The Planning Board may waive the provision of any or all improvements and requirements which are not, in its judgment, requisite in the interest of the public health, safety and general welfare. Waivers may also be granted in circumstances where such improvements and requirements are inappropriate because of the inadequacy or lack of connecting facilities adjacent to or in proximity to the subdivision. In order for a waiver to be granted by the Planning Board, appropriate conditions must be met and due cause shown. (See § 125-22.)
A. 
Streets. All streets shall be constructed, graded and paved in accordance with the standards and specifications for the same on file in the Village Clerk's office.
B. 
Drainage structures. Storm drains, culverts, catch basins and other drainage structures shall be installed in accordance with the standards on file in the Village Clerk's office and as shown on the final map approved by the Planning Board. All pipe shall comply with the requirements of the current New York State Highway Department specifications governing construction of these facilities. The location, length, depth, size, grade and type of pipe shall be designated on the plans. If unusual conditions are discovered at the time of construction which are not provided for on the plans, the Village Engineer shall determine the type and extent of construction required to overcome such conditions.
C. 
Curbs and gutters. Curbs and gutters shall be constructed on both sides of all streets shown on the proposed subdivision plat in accord with the standards on file in the Village Clerk's office.
D. 
Sidewalks. Sidewalks shall be required on both sides of collector and primary local service streets as shown in the Village Comprehensive Plan. Construction standards are on file in the Village Clerk’s office.

E. 
Street signs. Street signs shall be of metal and shall be installed at the intersections of all streets, in conformity with village specifications, at the locations approved by the Planning Board.
F. 
Grass strips. Grass strips shall be provided within the portion of the street right-of-way between the curbline and sidewalk and shall be properly graded and seeded.
G. 
Street trees.
(1) 
At least one street tree shall be planted on every lot in the subdivision. Existing trees of at least three inches caliper may be taken into consideration if shown on the final subdivision plat. New trees shall be located off the street right-of-way and shall be at least three feet from any required sidewalk and 10 feet from any line which is directly under utility wires.
(2) 
The minimum trunk diameter for new trees shall be at least 2 1/2 inches at the butt and have a minimum height of eight to 10 feet above finished grade level. Such trees shall meet and be installed and staked in accordance with the standards of the American Association of Nurserymen for planting and general stock, as well as of a species and at locations approved by the Planning Board. No tree shall be planted within 25 feet from an existing or proposed streetlight or street intersection.
(3) 
For projects with the Design Overlay Districts, refer to Section 2.4.4 of the Village of Chittenango Site and Architectural Design Standards for Commercial Design Overlay Districts.

H. 
Streetlighting. Streetlighting facilities shall be provided along all streets upon which the subdivision abuts. Such lighting facilities shall be in accordance with the residential standards as developed by the Niagara-Mohawk Power Corporation and shall be installed as directed and approved by the Niagara-Mohawk Power Corporation. For property within the Design Overlay Districts, refer to Section 2.4.3 of the Village of Chittenango Site and Architectural Design Standards for Commercial Design Overlay Districts.

I. 
Sanitary sewers.
(1) 
Provision shall be made for each lot in the subdivision to be connected to the village sewer system, in accordance with plans approved by the Village Engineer. Whenever possible, underground utilities shall be placed in the street right-of-way, between the paved roadway and the right-of-way line. The subdivider shall install service connections to the property line of each lot in the subdivision before the street receives its final pavement.
(2) 
Where conditions are such as to make impractical the inclusion of sanitary sewers within the street right-of-way, perpetual unobstructed easements at least 20 feet in width, with satisfactory maintenance access to a street, shall be provided.
J. 
Water supply. Where a public water main is reasonably accessible, the subdivider shall connect with such water main and provide a water connection for each lot in accordance with village standards, procedures and supervision. Fire hydrants shall be required and shall be installed in accord with the New York State Fire Underwriters' standards.
K. 
Monuments. Permanent monuments shall be set at block corners and at intervals of approximately 500 feet or such other distance as the Planning Board may determine appropriate, and their location shall be shown on the subdivision plat. Iron pipes shall not be considered permanent monuments for the purpose of these regulations. Specific standards for monuments are on file in the Village Clerk's office.
L. 
Utility and telephone lines. Utility and telephone lines shall be developed and installed in accord with the Niagara-Mohawk Power Corporation and the New York Telephone Company standards and any village standards that might be applicable.
When the Planning Board determines that a modification of required improvements is warranted, such modifications may be approved as part of the final subdivision plat. Modifications such as, but not limited to, the following examples may be approved:
A. 
Concrete curbing may be omitted, and in lieu thereof, rolled gutters or other means for controlling stormwaters may be constructed as may be approved by the Planning Board with concurrence from the Superintendent of Public Works.
B. 
Sidewalks may be omitted on one or both sides of the street to the extent deemed appropriate by the Planning Board, except for those streets or portions thereof located within the Commercial Design Overlay District boundaries as illustrated on the official Zoning Map.

C. 
Where curbing is not provided, adequate provision for the protection of the edge of the road pavement and graded shoulders at all driveway openings and other accessways shall be provided in a manner approved by the Planning Board with concurrence from the Superintendent of Public Works.
D. 
Where sidewalks and curbing are not provided, grass curb strips shall not be required. However, grading and seeding of the area between the pavement edge, shoulder or approved drainage structure and the front property line of the lot shall be required.
