The rules and regulations as set forth above may be revised and amended by the Planning Board. Such proposed amendments shall be subject to a public hearing by the Planning Board and enactment by the Village Board.
A. 
Any person or corporation, whether as owner, lessee, architect or builder, or the agent or employee of any of them, who violates or is accessory to the violation of any provision of the Subdivision Rules and Regulations of the Village of Chittenango or any amendment thereof or who shall erect, construct, alter, enlarge, convert or move any building or structure without compliance with such rules or regulations or in violation of any statement or plan submitted and approved under the provisions of such rules or regulations or who shall use any building, structure or land in violation of such rules or regulations shall thereby be guilty of a violation and, on conviction, shall be subject to a fine of $250 for each such violation or incarceration for up to 15 days or both.
B. 
Any person who fails to abate any said violation of the Subdivision Rules and Regulations of the Village of Chittenango within five calendar days after written notice has been served personally upon said person, or within 10 days after written notice has been sent to said person by certified mail to said person's home or business address, shall be subject to a civil penalty of $250 with cost, recoverable by suit brought by the village and to be retained by it.
C. 
Any said violation of the Subdivision Rules and Regulations of the Village of Chittenango may also be enjoyed pursuant to law.
D. 
The remedies provided for herein shall be cumulative and shall be in addition to any other remedies provided by law.
E. 
Each week's continued violation shall constitute a separate additional violation.
F. 
In the event of the failure or refusal of the proper enforcement officer, board or body of the village to institute appropriate action or proceeding after a period of 10 days has elapsed after the written request by a resident taxpayer of the village so to proceed upon a claimed violation, then any three taxpayers of the village residing in the district wherein such violation exists, who are jointly or severally aggrieved by such violation, may institute appropriate action or proceeding in like manner as such enforcement officer, board or body of the village is authorized to do.
If any article, section, subdivision, sentence, clause or phrase of these regulations is for any reason held to be unconstitutional, illegal or otherwise invalid, such decision shall not affect the remaining portions of these regulations.
This chapter shall take effect March 1, 1990, or after it is filed with the Secretary of State, whichever occurs later.
