It is the purpose of the Board of Trustees to provide for the health, safety and general welfare of the citizens of Greene and to maintain the aesthetic beauty of the Village by regulating the construction and use of streets and sidewalks and curbs within the Village of Greene in order to prevent hazards to the public health, safety and welfare.
A. 
Policy findings. It is the policy of the Board of Trustees of the Village of Greene to regulate the construction and use of streets, sidewalks and curbs within the Village of Greene. Failure to regulate the use of streets and sidewalks and curbs within the Village is determined by the Board of Trustees to be a hazard to the public health, safety and welfare and to the quality of the Village. It is further declared that the provisions herein set forth are in pursuance of and for the purpose of preserving, protecting and promoting the public health, safety and welfare of the Village residents and protecting the aesthetic value of said Village.
B. 
It is the finding of the Board of Trustees that unregulated construction and use of the streets, curbs and sidewalks within the Village degrades the environment of the Village to a degree which is harmful and detrimental to the health, safety and welfare of the inhabitants and interferes with the comfortable enjoyment of life, property and recreation and with the conduct of business and industry and causes nuisances and public disturbances.
As used in this chapter, the following terms shall have the meanings indicated:
PAVEMENT
Includes a macadam, asphalt, brick, concrete or other similarly improved roadbed, and is only applied to the portion of the street between the sidewalks or established curblines.
SIDEWALK
That portion of the street normally used for pedestrian traffic, whether improved with pavement or not.
STREET
Includes a highway, road, avenue, lane or alley which the public has a right to use; it is not limited to a traveled way used by vehicles, but also includes sidewalks.
A. 
The owner, lessee, tenant, occupant or other person having charge of premises abutting on any street where a sidewalk has been laid shall keep the sidewalk in front of such premises free and clear from snow, ice, dirt and other obstruction and shall, within 24 hours after a snowfall or other obstructing condition occurs or after the deposit of any dirt or other materials or obstructions upon such sidewalk, remove the snow, ice, dirt or other materials and/or obstructions from said sidewalk. This section is applicable to all premises regardless of whether said premises are occupied by a structure or not.
B. 
In case the snow or ice on the sidewalk shall be frozen, the owner, lessee, tenant, occupant or other person having charge of said premises shall distribute sand or other similar suitable material so that the dangerous condition is removed.
C. 
Sidewalks in commercial areas, as described in Chapter 125, Zoning, shall be kept free of obstructions which tend to impede normal pedestrian traffic. Displays in front of business premises should not extend more than four feet from the building. Displays on lawn areas or sidewalks shall not present a hazard to the pedestrian public or block the view of vehicle traffic.
D. 
In the event that the Village shall receive a complaint from users or shall notice that sidewalks have not been cleared of snow or ice or other obstructions, the Village shall notify the owner or occupant and give him a reasonable time to correct said condition. In the event that said owner or occupant fails to take remedial action within a reasonable time, the Village may perform the necessary repairs/work or hire it done and bill the property owner or other person responsible for the cost of the same.
E. 
In the event a property owner/occupant shall fail to keep the area between the curb and sidewalk properly mowed and cleaned or the area adjacent to the public street mowed in conformity with the prevailing standards in the neighborhood, the Village may mow or clean said area or hire it done and bill the property owner the cost of same.
A. 
No person shall, without written permission from the Village Superintendent of Public Works, construct, dig, remove or repair or replace any street, sidewalk or curbing within the Village of Greene. Said construction of streets, sidewalk or curbing shall be in accordance with the prevailing standards set forth by the Superintendent of Public Works.
B. 
Any person making an excavation in an existing street, authorized by the Superintendent of Public Works, shall be required to restore such street, highway, lane or public square to its original condition pursuant to the prevailing standards.
C. 
No person or persons shall undermine any public street, parking lot or way in this Village by digging upon lands adjacent to said lands.
D. 
The Village Board may consent to bear a portion of the expense of construction of sidewalks in accordance with § 6-620 of the Village Law.
E. 
The Village Board may cause a street to be graded or paved or repaved wholly at the expense of the Village or wholly at the expense of the owners of adjoining land or partly at the expense of each, in accordance with the provisions of § 6-622 of the Village Law.
Guidelines for sidewalks/lawn area in the business area of Genesee Street shall be as follows:
A. 
Sidewalks should not be blocked impeding pedestrians.
B. 
Displays on sidewalks should not extend more than four feet from a building.
C. 
Displays on lawn area/sidewalks must be taken in at closing.
D. 
No tent or awning structure should be constructed over displays on lawn area.
E. 
Good taste sandwich board signs are acceptable in lawn area.
F. 
The traditional farmers market products should include only homemade and home grown products, without a peddler's license.
Any person who shall violate any of the provisions of this chapter shall be punished by a maximum fine of $250 or a term of imprisonment not to exceed 15 days in jail, or both.
