It is the purpose of the Board of Trustees to provide for the health,
safety and general welfare of the citizens of Greene and to maintain the aesthetic
beauty of the Village by regulating the construction and use of streets and
sidewalks and curbs within the Village of Greene in order to
prevent hazards to the public health, safety and welfare.
A. Policy findings. It is the policy of the Board of Trustees
of the Village of Greene to regulate the construction and use of streets,
sidewalks and curbs within the Village of Greene. Failure to regulate the
use of streets and sidewalks and curbs within the Village is determined by
the Board of Trustees to be a hazard to the public health, safety and welfare
and to the quality of the Village. It is further declared that the provisions
herein set forth are in pursuance of and for the purpose of preserving, protecting
and promoting the public health, safety and welfare of the Village residents
and protecting the aesthetic value of said Village.
B. It is the finding of the Board of Trustees that unregulated
construction and use of the streets, curbs and sidewalks within the Village
degrades the environment of the Village to a degree which is harmful and detrimental
to the health, safety and welfare of the inhabitants and interferes with the
comfortable enjoyment of life, property and recreation and with the conduct
of business and industry and causes nuisances and public disturbances.
As used in this chapter, the following terms shall have the meanings
indicated:
PAVEMENT
Includes a macadam, asphalt, brick, concrete or other similarly improved
roadbed, and is only applied to the portion of the street between the sidewalks
or established curblines.
SIDEWALK
That portion of the street normally used for pedestrian traffic,
whether improved with pavement or not.
STREET
Includes a highway, road, avenue, lane or alley which the public
has a right to use; it is not limited to a traveled way used by vehicles,
but also includes sidewalks.
Guidelines for sidewalks/lawn area in the business area of Genesee Street
shall be as follows:
A. Sidewalks should not be blocked impeding pedestrians.
B. Displays on sidewalks should not extend more than four
feet from a building.
C. Displays on lawn area/sidewalks must be taken in at closing.
D. No tent or awning structure should be constructed over
displays on lawn area.
E. Good taste sandwich board signs are acceptable in lawn
area.
F. The traditional farmers market products should include
only homemade and home grown products, without a peddler's license.
Any person who shall violate any of the provisions of this chapter shall
be punished by a maximum fine of $250 or a term of imprisonment not to exceed
15 days in jail, or both.
