Fire prevention — See Ch. 98.
All fireworks shall be legally purchased from a duly authorized agent licensed and approved by the State of New York.
The fireworks will be in the possession of and handled by an individual or individuals duly approved and authorized by the State of New York and the Fire District Chief.
The Niles Town Board and the Fire District Chief shall be advised of the date of delivery and location for storage of the fireworks.
The Niles Town Board and the Fire District Chief shall be notified, in writing, at least 60 days prior to the day of the event. This time period may be reduced by a satisfactory showing of exigent circumstances to the Board.
A chain link fence or other appropriate barrier shall separate the public by at least 150 feet from the actual place where the fireworks are ignited on or discharged from the ground.
Appropriate medical personnel and fire control for the anticipated spectators shall be provided by the applicant and approved by the Niles Town Board and the Fire District Chief at least 30 days prior to the day of the event.
The applicant shall provide the Niles Town Board with a certificate of insurance at least 30 days prior to the event showing liability coverage at least in the amount of $500,000.
The applicant shall provide the Niles Town Board and the Fire District Chief with a sketch map showing the size and location of the grounds for the event, the location of the point of ignition or discharge of the fireworks, the location of the spectators, parking areas, roadways for ingress and egress, food service, toilet facilities, existing buildings on the premises, placement of medical and fire equipment and personnel, trees, telephone lines or other overhead obstructions.
The applicant shall comply with all the requirements of Penal Law § 405.00 and any other applicable laws as they relate to licensing and other provisions involving fireworks displays.
The Niles Town Board reserves the right to deny a permit to any person or persons failing to sufficiently provide them with the aforesaid information or documents, or whose application is determined by the Board to be insufficient to properly safeguard the safety, health, welfare and well-being of all persons or property within the area.
