The office of Borough Manager is hereby created by the Borough of Coudersport, subject to the right of the Borough Council to abolish said office at any time by ordinance.

The Manager shall be appointed by a majority of all of the members of the Council of the Borough of Coudersport to serve until his successor is elected and qualified for office. The said office shall be held by the Manager during the pleasure of Council. In the event of a vacancy, the Borough Council shall elect a replacement by a majority vote of all of its members for the unexpired term. The Manager may be removed at any time by a majority vote of all the members of the Borough Council.[1]

Before entering upon his duties, the Manager shall give a bond to the Borough with a bonding company as surety, to be approved by the Borough Council in the sum of $50,000, conditioned for the faithful performance of his duties. The premium shall be paid by the Borough. The bond of the Borough Manager may be included in and covered by any comprehensive bond now or hereafter in force or effect for all Borough employees of $50,000.
The salary of the Borough Manager shall be fixed from time to time by ordinance or resolution.

The Borough Manager shall be the Chief Administrative Officer of the Borough. He shall be responsible to the Borough Council for the proper administration of all affairs of all the departments of the Borough except police. His powers and duties shall relate to the general management of all Borough business not expressly or by statute or by ordinance imposed or conferred upon other officers including the following:
A. 
Supervisory duties.
(1) 
He shall supervise and be responsible for the activities of all municipal departments except police.
(2) 
He shall confer with department heads and crew foreman in the performance of the following duties:
(a) 
Develop objectives within each department, develop projects to meet objectives which Council has approved, and develop priorities for specific projects to accomplish these objectives.
(b) 
Coordinate the objectives and projects of the individual departments.
(c) 
Participate in the planning and approve work schedules and assignments for each department including streets, water, sewer, and administrative staff.
(d) 
Prepare recommendations, background information, and cost/labor estimates for projects for presentation at monthly council meetings.
(e) 
Inform department heads and the crew foreman of planned objectives and projects approved by Council.
(3) 
He shall present to Council by the March meeting of each year a schedule of construction and major repair projects, with estimated costs for Council approval.
(4) 
He shall be responsible for the completion of Council approved objectives and projects and see that such work meet the standards of Borough, county, state, or other authorities.
(5) 
He may delegate responsibilities and authorities to those under his supervision to carry out assigned functions and duties.
(6) 
He shall design, and on Council approval, administer personnel policies including:
(a) 
Job descriptions.
(b) 
Standards of conduct and performance.
(c) 
Operating procedures.
(d) 
Personnel evaluations by foremen or department heads.
(e) 
Negotiate wage scales for each appointed position as delegated by Council.
(f) 
Employees benefit plan.
(g) 
Training programs for Borough employees.
(h) 
Recommend changes in the Borough's administrative structure to reflect changing needs and economic conditions.
(7) 
He shall, when necessary for the Borough interests, suspend employees for up to three days, and shall report his actions to Council immediately, and at Council's direction he will then:
(a) 
Reinstate suspended employee:

With restitution of pay; or
[2] 
Without restitution of pay.
(b) 
Discharge suspended employee permanently only with Council's approval.
(8) 
He may employ, on Council approval, experts and consultants to perform work and to advise in connection with any of the functions of the Borough.
(9) 
All complaints regarding services or personnel of the Borough shall be referred to the office of the Manager after the immediate Supervisor's failure to resolve the problems in a timely manner.
B. 
Administrative duties.
(1) 
Budget.
(a) 
He shall prepare and submit to the Borough Council before the close of the fiscal year, or on such alternate date as the Borough Council shall determine a budget for the next fiscal year and an explanatory budget message. In preparing the budget, the Manager, or an office designated by him, shall obtain from the head of each department, agency, board, or officer estimates of revenue and expenditures and other supporting data as he requests. The Manager shall review such estimates and may revise them before submitting the budget to the Borough Council.
(b) 
He shall be responsible for the administration of the budget after its adoption by the Borough Council.
(c) 
He shall make a monthly report of revenues and expenditures, to Council, and a summary of the financial condition of the Borough including such reports as Council should request.
(d) 
He shall submit to the Borough Council as soon as possible after the close of the fiscal year, a complete report on the financial and administrative activities of the Borough for the preceding year.
(2) 
Transactions.
(a) 
He shall perform the duties of the Borough Treasurer according to the provisions of the Borough Code.
(b) 
Purchasing, under and administering contracts.

He shall receive requisitions with recommendations as to type, quantity, source, and price from department heads and other officials of the Borough.
[2] 
He shall purchase all supplies and equipment for the various departments, agencies, boards, and offices of the Borough.
[3] 
No purchase greater than $500 on a noncumulative basis shall be made without prior Council approval.
[4] 
He may issue rules and regulations governing purchasing procedures within the administrative organization as approved by Council.
[5] 
He shall let and administer contracts:
[a] 
He shall have prior approval of Council if contract is for new construction or if in excess of $500.
[b] 
He shall supervise the execution and faithful performance of contracts unless statute or ordinance expressly places such duty on some other Borough official.
[6] 
No purchase shall be made, or obligations incurred for any item or service which exceeds the current budget appropriation without a supplemental appropriation by Council.
[7] 
He shall not have the authority to make any purchase or let any contract where, according to Borough Code, advertising for bids is required, unless prior Council approval is gained.
(3) 
Secretarial.
(a) 
He shall perform the duties of the Borough Secretary according to the provisions of the Borough Code.
(b) 
He shall prepare the agenda for each meeting of the Borough Council and supply facts pertinent thereto.
(c) 
He shall receive and respond to communications from individuals, organizations and other government agencies and report on such to Council.
(d) 
He shall prepare and submit to other government agencies such reports, forms, and applications as they may require of the Borough.
(4) 
He shall see that the provisions of all franchises, leases, permits, and privileges granted by the Borough are observed.
C. 
General duties.
(1) 
He shall keep Council informed as to the business of the Borough and its agencies, and submit reports requested by Council.
(2) 
He shall attend all meetings of the Borough Council and its committees with the right to take part in the discussion, and shall receive notice of all special meetings of the Borough Council or its committees.
(3) 
He shall conduct the business of the Borough and its administrative organization so as to promote the best interests of the Borough.
(4) 
He shall make such recommendations to the Borough Council as he may deem necessary or expedient for the health, safety, or welfare of the community or for the improvement of administrative services.
(5) 
He shall investigate and make recommendations to Council concerning state, and federal, and private grants and aid programs and pursue such grants and aid as approved by Council.
(6) 
The Borough Manager shall perform such other duties as may be required by the Council not inconsistent with the law or Borough ordinances.
The Borough Manager shall devote his entire time to the discharge of his official duties.
In case of accident, disaster, or other circumstance creating a public emergency, the Borough Manager may award contracts and make purchases for the purpose of meeting said emergency; but he shall file promptly with the Council a certificate showing such emergency and the necessity for such action, together with an itemized account of all expenditures. No such emergency action shall be taken which is contrary to law.
If the Manager becomes ill or needs to be absent from the Borough, he shall designate one qualified member of his staff to perform the duties of the Manager during his absence or disability. The person so designated shall not perform these duties for a period longer than two weeks without the approval of the Borough Council.

Any vacancy in the office of Borough Manager shall be filled by election of a majority of the members of Borough Council.
