GENERAL REFERENCES
Dangerous buildings — See Ch. 107.
Abandoned property — See Ch. 284.
Prior to any scavenging, reclamation or demolition of any building or structure in the Borough of Coudersport, a permit shall be required. Any request for a permit shall include the following:
A. 
Full name, address, phone number and e-mail address of the property owner;
B. 
Exact location of the building or structure for which the permit is requested;
C. 
A detailed description of exactly what changes to the structure are desired to be made and precisely how each such change will be accomplished in a manner which will protect the health, safety and welfare of the residents of the Borough of Coudersport;
D. 
If any fixtures, portions or contents of the building are going to be removed, a statement describing in detail which portions of the building shall be removed (including a statement as to what percentage by weight and by volume and by value of the entire building is being removed) and to whom they are being sold and the use to be made of such portions;
E. 
If all or any portion of the building or structure is to be demolished, a statement that all demolition waste shall be delivered to the Potter County Solid Waste Authority;
F. 
If any building is proposed to be partially or completely scavenged, reclaimed or destroyed, the request for a permit shall contain a detailed plan addressing how all dust, contaminants and debris will be prevented from escape into the environment and shall address any and all disconnections or disruptions or any and all utilities;
G. 
If any building is proposed to be partially or completely scavenged, reclaimed or destroyed, the request for a permit shall contain a detailed plan addressing how the building will remain safe, secure and structurally sound during the entire process;
H. 
If any building is proposed to be partially or completely scavenged, reclaimed or destroyed, the request for a permit shall contain a detailed plan addressing how long the entire process will take and shall include a timetable for each activity proposed and shall also include a statement of the likely potential future value of the building and use which may be made of the building which has been partially but not completely scavenged, reclaimed or destroyed.
If any building or structure is proposed to be scavenged or reclaimed by removing more than 30% of the building whether measured by either volume or by weight or value, in such event a permit shall only issue which requires the complete demolition of the building or structure and filling of any foundation to form a flat building lot which shall be reseeded with grass or other suitable covering.
A. 
If any building or structure is proposed to be scavenged or reclaimed or destroyed such activities shall be conducted in a manner to minimize to the greatest extent possible all dust, contaminants and debris from escaping into the environment and shall minimize all disconnections or disruptions or any and all utilities.
B. 
If any building or structure is proposed to be scavenged or reclaimed or destroyed such activities shall be conducted in a manner to minimize to the greatest extent possible disruption of the structural integrity of the building and shall be conducted to the greatest extent possible in a safe, workmanlike and reasonable manner.
C. 
If any building or structure is proposed to be scavenged or reclaimed or destroyed such activities shall be conducted in a manner to minimize to the greatest extent possible the remaining structure from becoming unsafe, an attractive nuisance, a fire hazard or a blight upon the community.
D. 
If any building or structure is proposed to be scavenged or reclaimed or destroyed such activities shall be conducted in a manner to minimize to the greatest extent possible noise, disruption to neighboring property owners or residents, or a devaluation of the property values in the area near the building or structure.
A. 
Unless otherwise set forth in the permit granting the right to scavenge, reclaim or destroy a building or structure, all activities shall be completed within six months from the date of the granting of the permit; and after completion of such activities, such building or structure (or lot where such building or structure was previously situate) shall be placed in a safe, secure, orderly and attractive condition, and no demolition waste or other solid waste shall be stored upon the premises.
B. 
The owner of the building or structure shall notify the Borough of Coudersport upon the completion of any permitted activity under this chapter, and the Borough of Coudersport shall have the right to conduct a final inspection of both the interior and exterior of the building or structure and may document its condition by photographs or video recordings.
Any building which has more than 30% or its weight, volume or value removed or deteriorated is hereby declared to be a dangerous building which must be demolished.
Any person, firm or corporation who or which shall violate any provision of this chapter shall, upon his or its conviction, pay a fine of not less than $500 nor more than $1,000 or undergo imprisonment for a term not greater than 90 days, or both. Each day that a violation of this chapter exists shall constitute a separate violation of this chapter.
Any person aggrieved by a denial of a permit requested under this chapter may seek an appeal to the Borough Council of Coudersport under the provisions of the Local Agency Law as set forth in 2 Pa.C.S.A. § 551 et seq. and may thereafter seek a further appeal to the Court of Common Pleas of Potter County under the provisions of the Local Agency Law as set forth in 2 Pa.C.S.A. § 551 et seq.
Residential structures and ancillary residential structures (such as garages, shed, etc.) are hereby exempt from this chapter provided all of the following conditions are fulfilled by the property owners:
A. 
Each structure which is otherwise subject to the Ordinance is less than 3,000 square feet as measured by the outside perimeter of the structure's footprint with all floors being included in the square footage computation.
B. 
Prior to any scavenging, reclamation or demolition of any such structure, the property owner shall obtain a permit from the Borough of Coudersport, and the request for the permit shall specifically provide the information specified in § 118-1A and B of this chapter together with proof that the structure is subject to said exemption.
C. 
The Borough of Coudersport reserves the right to place appropriate conditions and restrictions on any permit which is issued.
