Any person who owns, harbors, keeps or is in charge of any animal within or frequenting the Borough of Coudersport shall not permit such animal or animals to be unattended within the Borough and shall require said animals to be restrained by a leash or other appropriate devise of control so that such animal cannot stray beyond the premises owned or occupied by such person or under reasonable control (by leash or other similar devise of control) of such person when said animal is not located upon lands owned or occupied by such person.
Any person owning, in possession of or in control of any such animal located within the jurisdictional limits of the Borough of Coudersport shall be responsible for said animal with regard to making proper provision for the elimination of said animal's bodily wastes including feces. Such proper provision shall be effectuated by "curbing" in a manner consistent with this article. Such "curbing" shall be permitted only on public streets and on private property with the express permission of the owner of such property.
Any person who "curbs" such an animal shall immediately remove all feces deposited by such animal by any sanitary method and same shall be deposited in the owner's garbage or disposed of in some other sanitary manner. The deposit shall be properly wrapped, packaged or protected so as to prevent unsightly disposal, smell or interference with the health and welfare of the community.
Any person or persons convicted of violating this article shall be subject to a fine of not more than $300 and costs.
