The Borough of Coudersport may require owners of property abutting on any street, including state highways, located within the Borough of Coudersport to construct, pave, repave and keep in good repair and in safe usable condition, a sidewalk, curb and gutter along such property, at such grades and under such regulations and specifications as set forth herein.
Where sidewalks or curbs are to be constructed, paved, repaved, or repaired over coal cellars or other excavations, such sidewalks shall be supported by iron or steel beams, girders, stone or concrete arches. Supports fabricated of wood or other perishable materials shall be prohibited.
A. 
Width. All sidewalks shall have minimum width of five feet.
B. 
Bed. All sidewalks shall be poured upon an adequate bed of bank gravel, 2RC, or equivalent material. In no event shall less than a three-inch thickness of bedding material be utilized.
C. 
Materials. All sidewalks shall be formed of poured concrete having six ninety-four-pound bags of concrete per yard and shall be reinforced with mesh wire.
D. 
Concrete thickness. All sidewalks shall have a concrete thickness of at least four inches. At all driveways and other locations where an automobile may travel upon the sidewalk, the sidewalk shall have a concrete thickness of at least six inches.
E. 
Grade. Where possible, all sidewalks shall have a minimum grade of six inches above the elevation of the center of the road and shall have a maximum grade of eight inches above the elevation of the center of the road. Where such a grade is not believed to be possible, the owner may request a waiver of this requirement from the Borough Manager (or Borough employee appointed by the Borough Manager.)
F. 
Surface conditions. All sidewalks shall be provided in sections with suitable expansion joints placed between said sections. The uppermost surface of each section shall be substantially coplanar with any adjacent sidewalk sections. Where required, a suitable slope may be utilized to provide a substantially continuous planar sidewalk surface. In no event shall steps be allowed.
G. 
Handicap ramps. At all locations where a sidewalk intersects with or terminates at a street, an access ramp extending from the upper surface of the street to the grade level of the sidewalk shall be constructed in a manner which allows wheelchairs and other wheeled structures to freely enter upon the sidewalk from the street surface.
Notice to construct, pave, repave and repair sidewalks, curbs or gutters shall be served upon the owner by the Borough by registered or certified mail if the abutting property owner is a resident of the Borough. If the owner is not a resident, then the notice may be served upon the agent or tenant of the owner, or upon the occupant of such premises. If there is no occupier of such premises, then service may be by notice posted upon the premises. Upon notification, such owner shall have 20 days to comply with said notice in conformity with the specifications prescribed by ordinance.
The owner shall provide advance notice to the Borough Manager (or Borough employee appointed by the Borough Manager) of when the required work will be performed and at any time during the performance of the required work, the Borough Manager (or Borough employee appointed by the Borough Manager) may inspect the work to determine whether the work is in compliance with all applicable specifications.
Upon the neglect or failure of any property owner to construct, pave, repave or maintain any sidewalk, curb or gutter in compliance with notice to do so, the Borough of Coudersport may do the same or cause the same to be done at the cost of such owner and the Borough may collect the cost thereof and 10% additional together with all charges and expenses, from such owner, and may file a municipal claim therefor and obtain a lien on the property or may collect the same by action in assumpsit.
Where, in the opinion of the Borough Manager (or Borough employee appointed by the Borough Manager), a dangerous condition exists that can be repaired by an expenditure of $500 or less, the Borough of Coudersport shall provide such property owner notice in accordance with the notice provisions of § 375-30 hereof stating emergency repairs are required. Upon failure of such owner to comply with the emergency notice with 48 hours after such notice, the Borough of Coudersport may make emergency repairs, at the cost of the owner, and the Borough may collect the cost thereof by filing a municipal claim therefor and obtain a lien on the property or may collect the same by action in assumpit.
Any property owner not required by notice to construct pave, repave or keep in repair sidewalks, curbs or gutters, may construct, pave, repave or repair the sidewalk, curb and gutter abutting his property; provided, that such owner shall first make application for a permit to the Borough of Coudersport before commencing work and, upon issuance of such permit, shall conform to the provisions of this and any other applicable ordinances or specifications. Further, such owner shall provide advance notice to the Borough Manager (or Borough employee appointed by the Borough Manager) of when the work will be performed and shall provide additional notice within two days after completion of the work.
This article supersedes any other conflicting provisions which may be in effect which relate to the construction, paving, repaving and the keeping of sidewalks, curbs and gutters along streets within the Borough of Coudersport in good repair and in a safe and usable condition. However, any all other ordinances shall remain in full force and effect to the extent that those provisions are more restrictive than those set forth herein.
