The Borough Manager and the Coudersport Borough
Council shall monitor the water supply for the Borough of Coudersport
and shall, by resolution and from time to time, make public announcements,
as the need arises, of the availability of water supplies to meet
the demand for the same within the service area of the Coudersport
Borough Water Department. To that end, Borough officials shall take
measurements from time to time as is necessary in order to measure
the available water supplies and shall compare those measurements
so taken with the schedule of triggering points which is attached
hereto as Exhibit A and incorporated herein by reference thereto. In the event
and from time to time as the need arises that the said measurements
reach one of the triggering points as set forth in Exhibit A then
the Borough Council of the Borough of Coudersport shall, by resolution,
declare the service area of the Coudersport Borough Water Department
to be in a drought condition and shall identify whether the drought
condition constitutes a stage one, stage two or stage three drought
condition as set forth in Exhibit A.
In the event that a resolution is passed by
the Coudersport Borough Council declaring the service area of the
Coudersport Borough Water Department to be in a stage one drought
condition then in such event the Borough Council shall take such effective
and necessary means as it deems advisable in order to encourage voluntary
restrictions of nonessential water use as may at that time be appropriate.
In the event that a resolution is passed by
the Coudersport Borough Council declaring the service area of the
Coudersport Borough Water Department to be in a stage two drought
condition then in such event the Borough Council shall take such effective
and necessary means as it deems advisable in order to require mandatory
restrictions of nonessential water use as may at that time be appropriate.
The Borough Council of the Borough of Coudersport at that time shall
implement mandatory restrictions of nonessential water use which may
include, but not necessarily be limited to the nonessential use ban
set forth in Exhibit B which is attached hereto and incorporated herein by reference
thereto.
In the event that a resolution is passed by
the Coudersport Borough Council declaring the service are of the Coudersport
Borough Water Department to be in a stage three drought condition
then in such event the Borough Council shall take such effective and
necessary means as it deems advisable in order to require mandatory
restrictions of nonessential water use as may at that time be appropriate.
The Borough Council of the Borough of Coudersport shall implement
and put in immediate effect and enforce the local water rationing
plan for the service area of the Coudersport Borough Water Department
which is attached hereto as Exhibit C and made a part hereof in addition to enforcing the nonessential
use ban set forth in Exhibit B.
The Borough Manager, the Mayor and the Police
Department of the Borough of Coudersport shall be charged with the
implementation and enforcement of this article and of the resolutions
which may from time to time hereinafter be passed in accordance herewith.
Any person who violates any of the terms of
this article or who fails to comply with any requirements which become
effective by virtue of the adoption of the resolution pursuant to
this article shall for such violation be fined a sum not to exceed
$1,000 or imprisonment not to exceed 30 days or both. Each days continuation
of a condition or conditions which constitutes a violation of this
article shall constitute a separate offense and be subject to a separate
penalty.
