A. 
Applications for service of the Borough of Coudersport water system shall be made in writing on a form to be provided by the Borough. All applications shall be accompanied by a filing fee in the amount of $5. This $5 fee is nonrefundable.
B. 
Any customer desiring to have his water service terminated shall provide a minimum of five days notice to the Borough of Coudersport by notifying the Borough Office.
C. 
Bills for water service shall be sent every two months, except when special arrangements are made with the Water Department. Bills are payable on receipt. Late charges shall be imposed 15 days after the billing date. If bills are not paid within 30 days of the date of billing, the Department may disconnect service after 10 days notice, said notice to be furnished to the owner of the property by mail and said notice to be posted conspicuously upon the property for 10 days prior to disconnection.
D. 
All property owners shall be responsible for water service furnished to their property. The Borough will, however, send bills to tenants upon receipt of a written agreement signed by the landlord and the tenant authorizing such billing. In all instances, however, the landlord will remain responsible for the final payment of the bill.
E. 
Applications shall be received for service within Coudersport Borough only, as it is not the policy of the Water Department to supply water to customers outside the physical boundaries of the Borough.
A. 
The Department shall make all connections to the mains, install and maintain all service lines from the main to the curb, the curb box and curb cock, all of which remain the property of the Department and under its exclusive control.
B. 
The owner shall place the service pipe from the curb cock to inside the wall of the building being supplied, a brass stop and waste cock, easily accessible to occupants, will be installed inside the building. In addition, a backflow valve is required in all new construction whenever a new water meter is installed.
(1) 
Owners of multifamily dwellings will provide a separate service line with shutoff valve for each dwelling unit in the building or pay regular bimonthly service charges for resident tenants.
(2) 
There shall be no hose bib, or other service connection, between the curb stop and the meter.
(3) 
There shall be no direct cross connection between the users system, served by the Borough water system, and any other well, cistern or spring. Any such illegal connection shall be cause for immediate termination of service without notice from the Borough water system until the time that such illegal cross connection is removed.
C. 
All leaks in service pipes from the curb to the premises shall be repaired promptly by the consumer. On failure to make repairs within a reasonable time, the water supply may be turned off by the Department and service will not be turned on until all necessary repairs shall have been made.
D. 
The practice of unnecessary use, or excessive use, or waste, no matter what the cause, is to be condemned by the Department and it is hereby authorized to use all reasonable means in abating such use or practice.
E. 
Users should bear in mind that water is not an inexhaustible resource and that excessive use for nonessential purposes could result in serious supply problems. The Borough reserves the right to curtail or restrict any uses of water when necessary for public health, safety and welfare.
A. 
The Borough will maintain all water mains, fire hydrants, source springs, holding reservoirs, etc., needed in the Borough water systems.
B. 
When a water service connection is needed, but is not in existence, from the street main to the curb stop, it will be installed by the Borough. From the curb stop, the owner is responsible for installing the water service main to the meter location and installing one meter furnished by the Borough. If the Borough does not install the meter, it shall be inspected and sealed by Borough personnel. The property owner shall pay to the Borough a connection fee, not less than $200, which shall be based upon the actual cost to the Borough. The actual cost shall be calculated by taking into account the following factors: the cost of materials involved in making the connection; the reasonable rental value of any equipment used in making the connection; the number of employees or personnel involved in making the connection; the rates (then in effect) for the skilled and unskilled personnel and employees (whichever is applicable) involved in making the connection; and any other expenses and costs incurred by the Borough in the making of said water connection.
C. 
When a water service connection already exists to the curb stop, the owner is responsible for installing the water service main from the curb stop to the meter furnished by the Borough. The connection fee is now fixed at $25 subject to change by action of Borough Council without amendment to these rules. There shall be no connection fee for replacement of an existing meter to existing plumbing suitable for meter installation.
D. 
The connection charges in such Subsections B and C above are established upon "base" installation using but one water meter. Where more than one meter is installed, the connection fee is now fixed at $10 for each additional meter, subject to change by action of Borough Council without amendment to this article.
E. 
When special water mains, other than standard, are needed to service a consumer, an extra charge will be made to the owner.
F. 
No attachments or detachments shall be made to or from the Borough water system, except under direction and control of the Borough's authorized agents.
G. 
No water consumer will be allowed to supply water to others, on a regular basis, except by special permit from the Borough. If found so doing without a permit, the water supply will be cut off.
H. 
Water from fire hydrants is to be used only in cases of fire, and at no other times and under no other circumstances, without special permission from the Borough.
I. 
In the case of fire, or an alarm of fire, or in making repairs on extensions, or for other emergencies, the Borough reserves the right to shut off the water supply at once, without notice, and to keep it shut off as long as may be necessary.
J. 
The Borough reserves the right to change rates for the use of water at any time, and to restrict the privileges granted on a uniform basis, as in their judgment may be found necessary for reasonable causes.
K. 
All water consumer services are to be metered. Meters are to be located on the premises so as to be protected from freezing, breakage and vandalism, and in an accessible position for the meter reader. The right is reserved to install extra meters when it is deemed advisable. Violation of this section shall be cause for the water supply to be shut off. The owner of the premises shall be responsible for all damage to water meters from freezing, breakage, vandalism or any other cause whatsoever. The Borough shall perform all repairs, with the cost to the property owner at the Borough's prevailing rate schedule.
L. 
The type and size of materials used and the methods of installation to be followed on all water installations shall be in accordance with the Borough water specifications in effect at the time of the installation. Violation of this section shall be cause for the water supply to be shut off.
M. 
It shall be the duty of owners to keep their pipes, hydrants, spigots, and other plumbing in good repair and to avoid all unnecessary waste of water. Waste of water shall be cause for the water supply to be shut off.
N. 
The Borough, or its agent, shall have reasonable access to meter locations at reasonable hours of the day.
O. 
Service connectors will be made to improved property only after written application as above provided. The Department will tap the main, insert a corporation cock, carry the service pipe to the curb, insert a curb cock stop and curb box for each consumer.
P. 
A user who wishes to discontinue receiving service when premises will be temporarily unoccupied shall notify the Department in writing, stating the date when service is to be discontinued. The water supply will be shut off on that date or the next regular working day and all charges for service shall cease from the time of requested shut off. Restoration of service will be made upon receipt of a written consent and a turn-on charge of $10. No allowance or refund will be made for unoccupied property when written notice has not been given. If the user prefers to have the water supply left on during absence, there will be a minimum charge of $1 for each full month of absence; service for a part of a month will be charged at pro rata rate.
Q. 
Turning on or turning off of water at the curb box by anyone other than an agent of the Department shall not be permitted. Other than for emergencies, there shall be a minimum charge for turning the water on or off at the curb box if such services are performed during hours other than Borough crew work hours.
R. 
Removing, repairing and replacing meters shall be done only by an agent or employee of the Department, except as herein provided.
S. 
Inquiries concerning the application of these rules and regulations should be directed on the Borough Manager and if there are any questions concerning their interpretation, the applicant or the consumer should immediately refer the matter to the Borough Council.
T. 
The Department may, in its discretion, discontinue service received by any applicant or user for any willful or malicious violation of these rules and regulations or any subsequent rules that may be promulgated.
U. 
If service has been discontinued for violation of the rules and regulations or for the nonpayment of service bills, as herein specified, a charge of $10 in addition to the delinquent service bill, shall be made by the Department for reinstating service which shall be paid before services are resumed. In a case of service being discontinued for nonpayment consumer must first pay all delinquent service bills and the Borough will collect a $25 fee for future service which may be returned when service with the consumer is discontinued, or may be applied to any unpaid portion of the service bill.
A. 
As heretofore noted, all service in the Borough shall be metered to the maximum extent possible. All meters shall be installed by the Department, except as provided herein, with the consumer or property owner to supply proper piping connections to receive the meter. A consumer or property owner shall make the proper connections available for meter installation within 60 days of receipt of notice from the Borough. The consumer or owner shall likewise supply suitable and adequate housing facilities for the meter, subject to the approval of the Borough.
B. 
The Borough reserves the right, however, to negotiate water supply agreements with individual customers as the need may arise, without regard to metering. All such negotiated arrangements shall be approved by the Borough Council.
C. 
Any customer desiring to have his meter tested shall request the same of the Borough, in writing, with the application to be accompanied by the deposit indicated below. If the requested test shows the meter in question is correct within 5%, said deposit shall be refunded and the account adjusted accordingly, provided however, that any adjustment shall be made for the current billing period only. Deposits required: one-inch or less: $5; one inch to two inches: $10; three inches: $25; four inches: $50; and six inches: $100.
These rules and regulations may be amended, supplemented, revised and added to at any time by resolution duly passed by the Council.
Any person violating any provisions of these rules and regulations, shall, upon a plea guilty, or conviction before a court having jurisdiction of the matter, be fined not more than $300, be imprisoned for not more than 30 days or both, together with court costs, for each offense. Each day's violation shall be deemed a separate offense.
