In those cases where the person or entity in possession of the premises being served by the public water system or the public sewer system (or both) is different from the owner of said premises (example: a landlord and tenant situation), the party in possession and the owner shall be jointly and severally liable for the fees, rates, charges and surcharges herein imposed. In all cases, the owner of the premises shall be liable for the fees, rates, charges and surcharges herein imposed.
A. 
Any structures containing three separate living quarters or less shall be billed separately (separate billings for both water use and for usage of the public sewer system) for each apartment or living quarter and each such separate living quarter or apartment shall be separately metered. A separate structure, such as an apartment rental or living quarters, shall also be treated as a separated residential structure which shall be separately metered and separately billed.
B. 
All residential structures which contain more than three individual living quarters or apartments shall, at the option of the property owner, be either separately metered (with each separate living quarter or apartment to be subject to separate billing) or be treated as commercial and all water used throughout and relative to the structure subject to being read through one meter.

All fees, rates, charges, surcharges and billings imposed under this article shall be due and payable immediately upon the date of billing. Any amount which is not paid in full within 20 days from the date of mailing shall be subject to and there is hereby imposed a late charge of 5% on the amount due, payable and unpaid. Any amount of any such fee, rate, charge, surcharge and billing imposed under this article which is unpaid after 30 days have expired from the date of mailing shall be subject to an interest charge where the interest shall accrue at the rate of 18% per annum. It is hereby imposed that said interest rate shall commence 30 days after the date of mailing.
The Borough Council of the Borough of Coudersport is hereby authorized, by resolution, to adopt, from time to time, and as often as it deems appropriate, such further rules and regulations as may be necessary or convenient to the proper administration of the public water system and public sewer system as it deems advisable and as may be necessary and convenient so as to better effectuate that which has been herein adopted.

The Borough Council of the Borough of Coudersport shall have, from time to time and at such times as it deems appropriate, the authority to comprise and settle any contested claim for any fee, rate, charge, surcharge and billing as they are imposed under this article.
