No person shall occupy as owner-occupant or shall let to another for
occupancy any building, building unit or storage unit which does not comply
with the following.
Every stair, hall, cellar, basement, utility room, furnace room and
similar nonoccupiable work space located in a structure used for human occupation
shall have either adequate natural or artificial light capable of providing
at all times not less than 50 foot-candles of light at floor level. Every
public hall and stairway shall also be adequately lighted at all times to
provide not less than 50 foot-candles of light at floor level.
Every occupiable room or bathroom shall be ventilated either by openable
areas directly accessible to the outdoors and equal to at least 45% of the
required window area or by equivalent mechanical ventilation.
The required bathrooms in each building unit shall be ventilated either
by an openable area directly accessible to the outdoors and not less than
1 1/2 square feet or by equivalent mechanical ventilation which shall
become automatically operable when the light switch is engaged.
At least 1/3 of the floor area of every occupiable room shall have a
ceiling height of at least eight feet. The floor area of that part of any
room where the ceiling height is less than five feet shall not be considered
as part of the floor area of the room for the purpose of determining the maximum
permissible occupancy thereof.
No basement space shall be used as an occupiable room or office unit
unless:
A. The floor and walls are impervious to leakage of underground
and surface runoff water and are insulated against dampness;
B. The requirements of §§
114-14 and
114-15 relating to natural light and ventilation in occupiable rooms are met; and
C. The required minimum window area is located entirely
above the grade of the ground adjoining such window area.
