Whenever, in the judgment of the Board of Commissioners
of Marple Township, it is deemed necessary or desirable to require
an owner or owners of any property or properties abutting on any street
or highway within the Township of Marple to grade, construct, pave
and/or curb the sidewalk along such property where it abuts upon a
street or highway, a resolution to this effect shall first be adopted
by the Board of Commissioners.
Subsequent to the adoption of said resolution,
the Township Manager or, in his absence, the President of the Board
of Commissioners shall promptly give written notice to the owner or
owners of property affected thereby to grade and construct the sidewalks
and/or curbs along that portion of their respective properties which
abuts upon the street or highway within a period of not less than
60 days from the date of the service of such notice.

Unless otherwise prescribed by ordinance, such
sidewalks and/or curbs shall be graded and constructed by the owners
of the affected properties with such materials, at such grades and
in accordance with specifications prescribed by the Public Works Committee
of this Board of Commissioners and the Township Engineer, and the
affected owners shall be notified of the requirement contained in
this section.
Included within the notice to be given under §
261-28 hereof, the Township shall furnish the affected owner or owners with a description of the materials to be used, the grade lines to be met and the specifications to be followed.
It shall be the duty of each affected owner
or owners to construct the same in a good and workmanlike manner within
the period of time above prescribed. Should any such owner or owners
fail to comply with the requirements of this article and the terms
of such notice within the time specified in such notice, this Board
of Commissioners shall cause the sidewalk and/or curb in front of
such property to be so constructed and the entire expense of the construction
thereof shall be and hereby is charged against such property and shall
become a lien against the property and shall be collectible as provided
by law.
