The Board of Trustees of the Village of Mount Kisco hereby designates the office of Byram Lake Watershed Inspector, which office shall be filled by an individual determined to be qualified and appointed by the Village Manager.
The Byram Lake Watershed Inspector shall make regular and thorough inspections of the wells, reservoirs, lake, watercourses and watersheds tributary thereto, as delineated in the map of the Byram Lake Watershed attached hereto as Attachment A,[1] for the purpose of ascertaining compliance with the rules and regulations set forth in 10 N.Y.C.R.R. 155.10.

A. 
The Byram Lake Watershed Inspector shall cause to be posted in the Byram Lake Watershed signs providing notice that violations of the rules and regulations governing activities in the Byram Lake Watershed are punishable under law by criminal and civil fines.
B. 
The Byram Lake Watershed Inspector shall inspect posted signs for their general good condition and cause repair or replacement of the signs where warranted.
The Byram Lake Watershed Inspector, upon determining that any person has violated the rules and regulations set forth in 10 NYCRR 155.10, shall serve notice of such violation and a copy of the same rules and regulations on the person and shall promptly notify the Westchester County Commissioners of Health and the state of such violation. The Byram Lake Watershed Inspector also shall send notice of such violations, including the name of the persons so served, to any newspapers circulated in the Village of Mount Kisco for publication.

It shall be the duty of the Byram Lake Watershed Inspector to develop, preserve and provide evidence of such violations to the Westchester County Commissioner of Health, the state and other pertinent governmental authorities for their further use.
B. 
It shall be the duty of the Byram Lake Watershed Inspector to report and to develop, preserve and provide any evidence of criminal activity to the Westchester County District Attorney's office and other prosecutorial authorities.
C. 
The Byram Lake Watershed Inspector shall assist the Village of Mount Kisco in the prosecution of any civil or criminal causes of action it may have against other persons pertaining to Byram Lake.
A. 
The Byram Lake Watershed Inspector shall maintain such records as necessary and shall apprise the Board of Trustees of the Village of Mount Kisco annually of the nature and extent of the Byram Lake Watershed Inspector's inspection activities, including the number of regular inspections made annually, the number of notices served and the general condition of the watershed at the time of the last inspection.
B. 
The Board of Trustees of the Village of Mount Kisco shall report to the State Commissioner of Health in writing annually, on or about the first day of January, the results of the regular inspections made during the preceding year, including the number of inspections which have been made, the number of violations found, the number of notices served and the general condition of the watershed at the time of the last inspection.
