The purpose of this chapter is to provide for the acquisition, by purchase or leasehold, and improvement of public parking areas within the areas defined in Chapter
110, Zoning, of this Code as being within the CB-1 and CB-2 zoning districts in the Village/Town of Mount Kisco by means of the establishment of a local improvement district pursuant to § 72-j of the General Municipal Law, § 10 of the Municipal Home Rule Law and Article 22 of the Village Law, whereby the cost of such acquisition and improvement may be apportioned and assessed, in part, upon the lands benefited thereby.
The cost of the local improvements authorized herein are to be borne as follows: 37.5% by the Village/Town of Mount Kisco and 62.5% by the owners of the lands benefited thereby, as defined in §
80-3 of this chapter.

The Board of Trustees hereby finds that the lands which will be benefited
by the local improvements authorized herein are all those parcels having frontage
on Kirby Plaza, East Main Street from Kirby Plaza to Green Street, South Moger
Avenue from Green Street to East Main Street, and North Moger Avenue from
East Main Street to a point 167 feet north of East Main Street, which such
parcels are identified on the tax map of the Village/Town of Mount Kisco as
parcels 69.73-02-13, 69.73-02-14, 69.73-02-15, 69.73-02-16, 69.73-02-17, 69.73-02-18,
69.73-02-19, 69.80-06-02, 69.80-06-03, 69.80-06-04, 69.81-01-03, 69.81-01-04,
69.81-01-05, 69.81-01-06, 69.81-02-03, 69.81-02-04, 69.81-02-05, 69.81-02-06,
69.81-02-07, 69.81-03-05, 69.81-03-06, 69.81-05-01, 69.81-06-01, 69.81-06-02,
69.81-06-03, 69.81-06-05, 69.81-06-06, 69.81-06-07, 69.81-06-08, 69.81-06-09,

constitute the Village Center Parking Improvement District.
The Village Manger is hereby authorized and directed to:
A. Prepare a map showing the lands determined herein to
be benefited by the authorized local improvement.
B. File a copy of such map in the office of the Village
Clerk.
C. Determine the cost of such improvement.

The portion of the cost of the local improvements authorized herein
which is to be borne by the lands benefited thereby is hereby apportioned
and assessed against those lands in accordance with their assessed value as
set forth in the Village Assessment roll, and in accordance with the apportionment
and assessment, and map thereof, filed in the office of the Village Clerk
of the Village/Town of Mount Kisco.
