It shall be unlawful for any person, firm or
corporation to sell or offer for sale at retail for use in internal
combustion engines in motor vehicles any gasoline unless such seller
shall post and keep continuously posted on the individual pump or
other dispensing device from which gasoline is sold or offered for
sale a sign or placard approximately 12 inches in height and 12 inches
in width, and stating clearly and legibly in whole numbers approximately
9 1/2 inches in height and 3 inches in width, and any fractions of
numbers shall be approximately 3 1/2 inches in height and 2 1/2 inches
in width, and said fractions of numbers shall have a line drawn thereunder
to designate such number as not being a whole number. The aforementioned
gasoline sign must contain the total price of the gasoline, including
taxes, in conformity with this article.

The amount of governmental tax to be collected
in connection with the sale of such gasoline shall be stated on such
sign or placard with sharply contrasting colors in dimensions of size
as follows: All letters and numerals, such as gas, federal and state
tax, sales tax and total, shall be of uniform size, approximately
one inch in height and 1/2 inch in width, including the words "includes
all taxes."

It shall be lawful for any person, firm or corporation
operating a gasoline station under this article to maintain, post
or display on the premises on which said gasoline is sold or offered
for sale one double-sided sign or placard stating the price or prices
of gasoline. Said sign shall be no larger than four feet in height
and four feet in width. The aforesaid gasoline sign must identify
the particular type of gasoline offered for sale and must contain
the total price thereof, including taxes, and otherwise be in conformity
with this article. Except as provided in this article and by the laws
of the State of New York, no other sign or placard stating the price
or prices of gasoline shall be posted or maintained on the premises
on which said gasoline is sold or offered for sale.

It shall be unlawful for any person, firm or
corporation to sell or offer for sale gasoline at retail, or any other
service, product or commodity, or to include lettering or numerals
on any sign in any manner so as to deceive a purchaser as to the price,
quality or identity of gasoline, or to sell or to offer for sale from
any pump or dispensing device any gasoline other than gasoline manufactured
or distributed by the manufacturer or distributor marketing such gasoline
under the name, trade name, brand, symbol or mark affixed to or maintained
on such pump or other dispensing device, or to substitute, mix or
adulterate gasoline sold or offered for sale under a name, trade name,
brand, symbol or mark.

Any person or persons, firm, company, association,
corporation or business of any kind violating any of the provisions
of this article shall be liable to a fine of $500 and/or 15 days in
jail for each violation. Any violation thereof shall constitute and
is hereby declared to be disorderly conduct, and any person or persons
violating this article or any provisions thereof shall be and is hereby
declared a disorderly person.
All other ordinances or parts of ordinances
in conflict with this article are hereby repealed.
This article shall take effect immediately.

It shall not be lawful for any person or persons,
firm, association or corporation to install any gasoline station,
gasoline pump or other apparatus adopted for the containing or the
furnishing of gasoline, or to install any apparatus for the furnishing
of air or water to motor vehicles, in any portion of the public streets
within the Village of Valley Stream, Nassau County, New York, without
first obtaining from the Board of Trustees of said Village a permit
for the installation thereof.

A. Any person or persons, firm, company, association,
corporation or business of any kind violating any of the provisions
of this article or any part thereof shall be liable for and forfeit
and pay a penalty of not more than $2,000 and/or 15 days in jail for
each violation thereof, for the use of said Village. When a violation
of this article is continuous, every 24 hours thereof shall constitute
a separate and distinct violation.
B. Any violation of this article or any part thereof
shall constitute disorderly conduct, and any person violating this
article or any part thereof shall be and is hereby declared a disorderly
person.
