For the purposes of this chapter, the words "vehicle," "owner" and "parked" shall have the meanings as defined in the Vehicle and Traffic Law of the State of New York.
Where any vehicle is parked, unattended or abandoned within the Incorporated Village of Valley Stream on any highway, parking field, lot or facility during any public emergency or under such conditions where it constitutes an obstruction to traffic or the free movement of vehicular traffic or any place where stopping, standing or parking is prohibited or restricted and where such vehicle is stopped, standing or parked in violation of such restriction, said vehicle may be removed by the Village of Valley Stream or its agents.
After such removal, the Village of Valley Stream may store such vehicle in a suitable place at the expense of the owner. Such owner or person in charge of the vehicle may redeem the same upon payments to the Village of Valley Stream of the amount of all expenses actually and necessarily incurred in effecting such removal, together with any charges for storage and together with any fine imposed for the violation of any applicable law.
The Village Clerk, without delay, shall report the removal and disposition of any vehicle removed to the Mayor and the Police Department of the County of Nassau.
All ordinances, local laws or resolutions or parts of ordinances, local laws or resolutions of the Village of Valley Stream inconsistent with the provisions of this chapter are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency, and in all respects this chapter shall be in addition to other legislation regulating and governing the subject matter covered by this chapter.
If any section, paragraph, subdivision or provision of this chapter shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this chapter as a whole or any part or provision thereof other than the part so decided to be invalid or unconstitutional.
This chapter shall take effect immediately as provided by law.
