All curbs, curb cut ramps and sidewalks shall be constructed or reconstructed in accordance with the terms and provisions of this article. It shall be the duty of all owners of real estate, contractors, subcontractors, mechanics and laborers to comply with this article in the construction or reconstruction of curbs and sidewalks within the Township.

All curbs shall be vertical plain cement concrete constructed or reconstructed in accordance with specifications and design standards of the Pennsylvania Department of Transportation Publication 408 Specifications, 1994, Section 630, as amended from time to time, including but not limited to excavation, forms, placing, finishing, curing, joints and all materials. Replacement curb shall be installed to the existing line and grade of the curbing, unless otherwise directed by the Township Engineer.

All sidewalks shall be four inches of cement concrete on an aggregate bed which shall be constructed or reconstructed in accordance with the specifications as set forth in the Pennsylvania Department of Transportation Publication 408 Specifications, 1994, Section 767, as amended from time to time, including but not limited to preparation of foundation, aggregate bed, forms, concrete, joints, curing and all materials.
Curb cut ramps shall be provided when constructing new sidewalks and curbs or reconstructing existing sidewalks and curbs. Curb cut ramps will not be required when an existing single-family dwelling has a curb and sidewalk and there is a replacement of only one item, curbing or sidewalk. Handicapped ramps shall be provided, where feasible, at all intersections and crosswalks if there is no driveway depression in the curb within 100 feet. Ramps shall be constructed in accordance with the guidelines and design criteria contained in the Pennsylvania Department of Transportation Publication 70, entitled "Guidelines for Design of Local Roads and Streets," as amended from time to time. The Board of Commissioners may waive installation of ramps where not feasible, at hazardous conditions or at unavoidable permanent obstructions.
All curbs, curb cut ramps or sidewalks shall be backfilled with clean earth to the top of the curb or sidewalk and to match existing grades. All excess material shall be removed and all disturbed areas shall be reseeded. Any pavement cut, damaged or disturbed shall be replaced.
A. 
All macadam, timber or other noncement concrete curbs shall be replaced with vertical plain cement concrete curbing as provided in this article.
B. 
Existing rolled cement concrete curbs can be replaced to match existing rolled curb, provided that less than 50% of the existing rolled curb of the property requires replacement, and further, provided that abutting properties have rolled curb.
The Board of Commissioners, upon request, may approve substitute materials for curbing for landscaping purposes on public or private property when the Township Engineer provides an opinion that the substitute material shall have an expected life of not less than 20 years.

Any deviation from the regulations set forth in this article is subject to the approval of the Township Engineer or the Board of Commissioners.
Before constructing or reconstructing any curb or sidewalk, it shall be the duty of all owners of real estate, contractors, subcontractors, mechanics and laborers to secure the necessary permit, line and grade from the Township, authorizing the requested construction or reconstruction.
It shall be the duty of every owner of real estate, previous to the construction or reconstruction of curbing or sidewalks, footways or gutters on any street or alley in the Township, to make application for a permit to the Township to fix the line and grade for the construction or reconstruction of curbing, sidewalk or gutters. Such permit, when duly issued by the Township, shall be sufficient authority for such owner or his contractor, subcontractor, mechanic or laborer to commence and complete, along such lot or ground as may be described in such permit and in accordance with the regulations, rules and specifications fixed and established by this article and none other, to construct or reconstruct sidewalks or gutters for which such permit has been granted. Grade stakes and offset stakes will be given by the Township Engineer at the time of the issuance of the permit. The Township will be given five days' notice prior to the date the owner wishes to commence construction so that there will be sufficient time to place the construction stakes.
The fee for such permit shall be set by resolution of the Board of Commissioners, which fee schedule shall be posted for public inspection in the office of the Township Code Official and shall be based on cost. When sidewalk or curb is constructed or reconstructed simultaneously, only one permit and fee shall be required.
If any sidewalk or curb hereafter constructed or reconstructed is not constructed or reconstructed in conformity to the lines and grades established by the Township Engineer, it shall be the duty of the person laying the same, upon notice from the Township Engineer or the Township Manager, so to alter and construct the same as to conform to the official lines and grades. Failure within five days after such notice to comply with the notice and the requirements of this article shall be a violation of this article, and each day's neglect and refusal to comply with the terms of the notice shall constitute a separate offense.
