This article shall be known and may be cited as the "Lower Allen Township Snow, Ice and Bad Weather Ordinance."

Snow or bad weather parking restrictions may be declared to exist in the Township whenever snow falls during any period of 12 hours or less to an accumulative depth of three inches or more or at any other time, at the discretion of the Township Manager or his designee, the weather conditions are too hazardous and dangerous to vehicular and pedestrian travel because of the elements. The Township Manager or his designee shall have authority to declare a snow or bad weather emergency, notice of which shall immediately be given through the press, if possible, but in any event through not less than two radio or television stations with a normal operating range covering the Township. Notification of termination of snow or bad weather emergency shall be provided to the media for announcement.

A. 
It shall be unlawful for any person to place any snow or ice (whether by shoveling, sweeping, plowing, blowing, pushing, dumping or otherwise) upon any public street or road within this Township.
B. 
It shall be unlawful for any person or entity to cause or permit any person to place any snow or ice (whether by shoveling, sweeping, plowing, blowing, pushing, dumping or otherwise) upon any public street or road within this Township.
C. 
A person or entity shall be presumed to have caused or permitted a person to place snow or ice upon a public street or road where such person or entity owns, occupies or otherwise controls the land from which the snow or ice originated and employs, contracts with or otherwise engages the person placing the snow or ice upon said street or road.
D. 
It shall be unlawful for any person or entity to cause or permit any person to place any snow or ice (whether by shoveling, sweeping, plowing, blowing, pushing, dumping, or otherwise) upon the property of another with the exception of authorized agents of the Township in the course of snow/ice removal from the public streets or roads or sidewalks.
E. 
It shall be unlawful for any person to place any snow or ice (whether by shoveling, sweeping, plowing, blowing, pushing, dumping or otherwise) upon or in front of any fire hydrant.

A. 
Every person in charge or control of any building or lot of land fronting or abutting on a sidewalk, whether as owner, tenant, occupant, lessee or otherwise, shall remove and clear away or cause to be removed or cleared away all snow, ice, slush, or any combination thereof from all of the sidewalks in front of or alongside such building or lot from a path of at least 36 inches in width from so much of said sidewalk as is in front of or abuts on said building or lot of land within 24 hours after the snow, ice, slush or combination ceases to fall, to form or to accumulate. If the sidewalk is less than 36 inches in width, said sidewalk shall be cleared the entire width thereof.
B. 
Every person in charge or control of any building or lot of land fronting or abutting on a public right-of-way, whether as owner, tenant, occupant, lessee or otherwise, shall remove and clear away, or cause to be removed or cleared away, all snow, ice, slush, or any combination thereof from any fire hydrant in front of or alongside such building in an area 36 inches in radius around the fire hydrant within 24 hours after the snow, ice, slush or combination ceases to fall, to form, or to accumulate.

A. 
Snow, ice, slush or any combination thereof removed from the sidewalk shall be placed on the property of the person. Said snow, ice, slush or any combination thereof shall not be placed next to a fire hydrant or on any sidewalk, roadway or loading or unloading area of a public transportation system.
B. 
If there shall be an excessive amount of snow, ice, slush or combination thereof and there is no longer any place on the property of the person to pile the snow, ice, slush or combination thereof, it may be placed along the curbline but may not be placed in the street.
C. 
In the event that the snow and/or ice on a sidewalk has become so hard that it cannot be removed without likelihood of damage to the sidewalk, the person charged with its removal shall, within the time set forth in § 187-52, cause enough sand, ashes, sawdust or any other abrasive material to be put on the sidewalk to make travel reasonably safe and shall, as soon thereafter as weather permits, cause to be cleared a path in said sidewalk of at least 36 inches in width.

A. 
Upon declaration of snow or bad weather parking restrictions, all vehicles shall be removed from the streets and roadways within the Township by a time designated by the Township Manager or his designee. Said time shall not be less than six hours after the snow or bad weather parking restrictions have been declared.
B. 
No vehicles shall be parked on the streets and roadways of the Township until the snow or bad weather parking restrictions have been lifted. During the snow or bad weather parking restrictions, certain other parking restrictions such as blocking sidewalks and parking within the front or side yards of residences shall be relaxed.
C. 
Upon the lifting of the snow or bad weather emergency, regular parking restrictions shall apply unless otherwise notified.
