On and after the effective date of this chapter no person, firm or corporation
shall move into or remove from or cause his personal property to be so moved
or removed from any house, dwelling or other building, within the Township
of Lower Makefield, Bucks County, Pennsylvania, without first having obtained
a permit therefor from the Secretary of the Board of Supervisors of the Township
of Lower Makefield.
Every person, firm or corporation seeking a permit to occupy any premises
shall file an application with the Secretary of the Board of Supervisors of
the Township of Lower Makefield setting forth his or her name, location of
the premises, name of owner and his or her address, the nature of the proposed
use of the building and, if for residence purposes, the name and ages of the
occupants, and should such application comply with the Ordinances of the Township
of Lower Makefield and all other laws, then and in that event the aforesaid
Secretary shall forthwith issue a permit of occupancy, without charge.
Every person, firm or corporation seeking a permit to remove from any
premises in the said Township of Lower Makefield shall file an application
with the Secretary of the Board of Supervisors of the Township of Lower Makefield
at least five (5) days prior to such expected time of removal setting forth
his or her name, address, the expected time of departure and attach thereto
receipted tax bills for the current year.
Upon receipt of such applicant, it shall be the duty of the Secretary
of the Board of Supervisors of the Township of Lower Makefield to issue the
requested permit, without charge, if the indicated use does not violate any
of the ordinances of the Township of Lower Makefield or if there are no outstanding
obligations due the Township of Lower Makefield.
It shall be unlawful for any person, firm or corporation to transport
or remove its own or the personal property of another person which said person
is moving into or removing from a house, dwelling or other building within
the Township of Lower Makefield unless such person so moving into or removing
from said Township of Lower Makefield shall have first obtained the permit
as hereinbefore provided. It shall be the duty of such person, firm or corporation
transporting or removing the personal property of itself or of another person
to or from the Township of Lower Makefield to ascertain that the person, firm
or corporation whose property is to be so transported or removed has obtained
the permit as herein before required.
Nothing contained in this chapter shall be construed to require any
farmer selling the products of his farm or the owner of tangible personal
property held for the purpose of manufacturing in the ordinary course of his
business or held for the purpose of sale or resale in the ordinary course
of business, to obtain any such permit to transport or remove such tangible
personal property from or to any farm, storehouse, warehouse or usual place
of business; and nothing contained in this chapter shall be construed as to
requiring any hotel, lodging house or rooming house to obtain any such permit
for the use of transient guests or to require such transient guests to obtain
such permit.
It shall be unlawful for any person, firm or corporation to move into
or remove from or cause his, her or its personal property to be so moved into
or from any house, dwelling or other building between the period of from two
(2) hours after sunset and sunrise of any day or at any time on the first
day of the week, commonly called Sunday.
Any person, firm or corporation, who or which shall fail to comply with
any of the provisions of this chapter shall be liable, upon conviction before
any District Justice of Bucks County, to pay a fine or penalty not exceeding
the sum of six hundred dollars ($600.) plus court costs and reasonable attorney
fees for each such violation. If the defendant neither pays nor timely appeals
the judgment, the township may enforce the judgment pursuant to the applicable
rules of civil procedure.
