Pursuant to the Supreme Court of the State of
New Jersey, and N.J.S.A. 2B:24-1 et seq., there is hereby created
the office of Municipal Public Defender, who shall be designated as
the "Borough Public Defender."
The Borough Public Defender shall be appointed
by the Mayor with the advice and consent of the Borough Council.
The term of the Borough Public Defender shall
be one year from the date of such appointment and the advice and consent
of the Borough Council.
The Borough Public Defender shall perform such
duties as are provided by general law and ordinance, and shall appear
in the North Arlington Municipal Court at such time and in such matters
as are designated by the Judge of the Municipal Court of North Arlington.
The retainer of the Borough Public Defender
shall be fixed by an annual salary by the Borough of North Arlington.

Each individual applying for representation
by a Municipal Public Defender shall be required to pay an application
fee of not more than $200. The Municipal Court Judge may waive any
required application fee, in whole or in part, if the Court determines,
in its discretion, that the application fee represents an unreasonable
burden on the individual seeking representation.
